제48조 고액ㆍ상습체납자의 인적사항 공개 및 공개 제외 사유 등

법 제83조제1항 단서에서 "체납된 금액의 일부 납부 등 대통령령으로 정하는 사유가 있는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <개정 2020.6.2>
1. 법 제83조제3항에 따른 통지 당시 체납된 보험료, 연체금 및 체납처분비(이하 이 조에서 "체납액"이라 한다)의 100분의 30 이상을 그 통지일부터 6개월 이내에 납부한 경우
2. 「채무자 회생 및 파산에 관한 법률」 제243조에 따른 회생계획인가의 결정에 따라 체납액의 징수를 유예받고 그 유예기간 중에 있거나 체납액을 회생계획의 납부일정에 따라 내고 있는 경우
3. 재해 등으로 재산에 심한 손실을 입었거나 사업이 중대한 위기에 처한 경우 등으로서 법 제83조제2항에 따른 보험료정보공개심의위원회(이하 "보험료정보공개심의위원회"라 한다)가 체납자의 인적사항ㆍ체납액 등(이하 "인적사항등"이라 한다)을 공개할 실익이 없다고 인정하는 경우
The phrase "cases where there are reasons such as partial payment of the delinquent amount, etc., as prescribed by Presidential Decree" in the proviso to Article 83 (1) of the Act shall mean cases falling under any of the following subparagraphs. <Amended by Presidential Decree No. 30804, Jun. 2, 2020> 1. Cases where 30 percent or more of the insurance premiums, late charges, and delinquent disposition expenses (hereinafter referred to as "delinquent amounts" in this Article) that were delinquent at the time of notification under Article 83 (3) of the Act have been paid within 6 months from the date of notification. 2. Cases where the collection of delinquent amounts has been deferred under a decision to approve a rehabilitation plan pursuant to Article 243 of the Debtor Rehabilitation and Bankruptcy Act, and the person is within the deferral period or is paying the delinquent amounts according to the payment schedule of the rehabilitation plan. 3. Cases where the Insurance Premium Information Disclosure Review Committee (hereinafter referred to as the "Insurance Premium Information Disclosure Review Committee") under Article 83 (2) of the Act determines that there is no practical benefit in disclosing the personal information, delinquent amounts, etc. (hereinafter referred to as "personal information, etc.") of the delinquent, such as when the person has suffered severe losses to their property due to a disaster or when their business is in a grave crisis.
공단과 보험료정보공개심의위원회는 법 제83조제3항에 따른 인적사항등의 공개대상자를 선정할 때에는 체납자의 재산상태, 소득수준, 미성년자 여부, 그 밖의 사정을 종합적으로 고려하여 납부능력이 있는지를 판단하여야 한다.
When selecting persons subject to disclosure of personal information, etc. under Article 83 (3) of the Act, the Corporation and the Insurance Premium Information Disclosure Review Committee shall determine whether the delinquent has the ability to pay by comprehensively considering the delinquent's financial status, income level, whether they are a minor, and other circumstances.
공단은 법 제83조제3항에 따라 인적사항등 공개대상자임을 통지할 때에는 체납액의 납부를 촉구하고, 같은 조 제1항 단서에 따른 인적사항등의 공개 제외 사유에 해당하면 그에 관한 소명자료를 제출하도록 안내하여야 한다.
When notifying persons subject to disclosure of personal information, etc. under Article 83 (3) of the Act, the Corporation shall urge the payment of delinquent amounts and guide the submission of supporting documents if the person falls under the grounds for exclusion from disclosure of personal information, etc. as per the proviso to Article 83 (1) of the Act.
공단은 법 제83조제4항에 따라 인적사항등을 공개할 때에는 체납자의 성명, 상호(법인의 명칭을 포함한다), 나이, 업종ㆍ직종, 주소, 체납액의 종류ㆍ납부기한ㆍ금액, 체납요지 등을 공개해야 하고, 체납자가 법인인 경우에는 법인의 대표자를 함께 공개해야 한다. <개정 2023.6.20>
