제100조 위반사실의 공표

보건복지부장관은 관련 서류의 위조ㆍ변조로 요양급여비용을 거짓으로 청구하여 제98조 또는 제99조에 따른 행정처분을 받은 요양기관이 다음 각 호의 어느 하나에 해당하면 그 위반 행위, 처분 내용, 해당 요양기관의 명칭ㆍ주소 및 대표자 성명, 그 밖에 다른 요양기관과의 구별에 필요한 사항으로서 대통령령으로 정하는 사항을 공표할 수 있다. 이 경우 공표 여부를 결정할 때에는 그 위반행위의 동기, 정도, 횟수 및 결과 등을 고려하여야 한다.
1. 거짓으로 청구한 금액이 1천 500만원 이상인 경우
2. 요양급여비용 총액 중 거짓으로 청구한 금액의 비율이 100분의 20 이상인 경우
The Minister of Health and Welfare may publish the name and address of the medical institution, the name of its representative, and other matters necessary to distinguish it from other medical institutions, as well as its violative act and the details of the disposition, if a medical institution that has received an administrative disposition under Article 98 or Article 99 by falsely claiming medical care benefit costs through the forgery or alteration of related documents falls under any of the following subparagraphs. In this case, when deciding whether to publish, the motive, degree, frequency, and results of the violative act shall be considered. 1. When the amount falsely claimed is 15 million won or more 2. When the proportion of the falsely claimed amount to the total medical care benefit costs is 20 percent or more
보건복지부장관은 제1항에 따른 공표 여부 등을 심의하기 위하여 건강보험공표심의위원회(이하 이 조에서 "공표심의위원회"라 한다)를 설치ㆍ운영한다.
The Minister of Health and Welfare shall establish and operate the Health Insurance Publication Review Committee (hereinafter referred to as the "Publication Review Committee" in this Article) to deliberate on whether to publish pursuant to paragraph ①.
보건복지부장관은 공표심의위원회의 심의를 거친 공표대상자에게 공표대상자인 사실을 알려 소명자료를 제출하거나 출석하여 의견을 진술할 기회를 주어야 한다.
The Minister of Health and Welfare shall inform the subject of publication, who has undergone deliberation by the Publication Review Committee, of the fact that they are a subject of publication, and give them an opportunity to submit explanatory materials or appear in person to state their opinion.
보건복지부장관은 공표심의위원회가 제3항에 따라 제출된 소명자료 또는 진술된 의견을 고려하여 공표대상자를 재심의한 후 공표대상자를 선정한다.
The Minister of Health and Welfare shall select the subject of publication after the Publication Review Committee has re-deliberated on the subject of publication, taking into consideration the explanatory materials submitted or opinions stated pursuant to paragraph ③.
제1항부터 제4항까지에서 규정한 사항 외에 공표의 절차ㆍ방법, 공표심의위원회의 구성ㆍ운영 등에 필요한 사항은 대통령령으로 정한다.
Matters necessary for the procedure and method of publication, the composition and operation of the Publication Review Committee, etc., in addition to what is provided in paragraphs ① through ④, shall be determined by Presidential Decree.
