①

건강보험정책에 관한 다음 각 호의 사항을 심의ㆍ의결하기 위하여 보건복지부장관 소속으로 건강보험정책심의위원회(이하 "심의위원회"라 한다)를 둔다. <개정 2016.2.3, 2024.1.9, 2024.2.6>

  1. 1. 제3조의2제1항 및 제3항에 따른 종합계획 및 시행계획에 관한 사항(의결은 제외한다)

  2. 2. 제41조제3항에 따른 요양급여의 기준

  3. 3. 제45조제3항 및 제46조에 따른 요양급여비용에 관한 사항

  4. 4. 제73조제1항에 따른 직장가입자의 보험료율

  5. 5. 제73조제3항에 따른 지역가입자의 보험료율과 재산보험료부과점수당 금액

  6. 5의2. 보험료 부과 관련 제도 개선에 관한 다음 각 목의 사항(의결은 제외한다)

    1. 가. 건강보험 가입자(이하 "가입자"라 한다)의 소득 파악 실태에 관한 조사 및 연구에 관한 사항
    2. 나. 가입자의 소득 파악 및 소득에 대한 보험료 부과 강화를 위한 개선 방안에 관한 사항
    3. 다. 그 밖에 보험료 부과와 관련된 제도 개선 사항으로서 심의위원회 위원장이 회의에 부치는 사항

  7. 6. 그 밖에 건강보험에 관한 주요 사항으로서 대통령령으로 정하는 사항

In order to deliberate and decide on the following matters concerning health insurance policy, a Health Insurance Policy Deliberation Committee (hereinafter referred to as the "Deliberation Committee") shall be established under the Minister of Health and Welfare. <Amended by Act No. 13121, Feb. 3, 2016, Act No. 19967, Jan. 9, 2024, Act No. 20197, Feb. 6, 2024> 1. Matters concerning the comprehensive plan and implementation plan under Article 3-2 (1) and (3) (excluding decisions) 2. Standards for medical care benefits under Article 41 (3) 3. Matters concerning medical care benefit costs under Article 45 (3) and Article 46 4. Insurance premium rate for workplace subscribers under Article 73 (1) 5. Insurance premium rate for regional subscribers and the amount per property insurance premium assessment point under Article 73 (3) 5-2. The following matters concerning the improvement of the insurance premium assessment system (excluding decisions) a. Matters concerning surveys and research on the current status of income identification of health insurance subscribers (hereinafter referred to as "subscribers") b. Matters concerning improvement measures for strengthening income identification of subscribers and insurance premium assessment based on income c. Other matters concerning the improvement of the system related to insurance premium assessment, which the Chairperson of the Deliberation Committee refers to the meeting 6. Other major matters concerning health insurance as determined by Presidential Decree

심의위원회는 위원장 1명과 부위원장 1명을 포함하여 25명의 위원으로 구성한다.

The Deliberation Committee shall be composed of 25 members, including one Chairperson and one Vice-Chairperson.

심의위원회의 위원장은 보건복지부차관이 되고, 부위원장은 제4항제4호의 위원 중에서 위원장이 지명하는 사람이 된다.

The Chairperson of the Deliberation Committee shall be the Vice Minister of Health and Welfare, and the Vice-Chairperson shall be a person designated by the Chairperson from among the members under paragraph (4) 4.

④

심의위원회의 위원은 다음 각 호에 해당하는 사람을 보건복지부장관이 임명 또는 위촉한다.

  1. 1. 근로자단체 및 사용자단체가 추천하는 각 2명

  2. 2. 시민단체(「비영리민간단체지원법」 제2조에 따른 비영리민간단체를 말한다. 이하 같다), 소비자단체, 농어업인단체 및 자영업자단체가 추천하는 각 1명

  3. 3. 의료계를 대표하는 단체 및 약업계를 대표하는 단체가 추천하는 8명

  4. 4. 다음 각 목에 해당하는 8명

    1. 가. 대통령령으로 정하는 중앙행정기관 소속 공무원 2명
    2. 나. 국민건강보험공단의 이사장 및 건강보험심사평가원의 원장이 추천하는 각 1명
    3. 다. 건강보험에 관한 학식과 경험이 풍부한 4명

The Minister of Health and Welfare shall appoint or recommend members of the Deliberation Committee from among the following. 1. Two persons each recommended by labor organizations and employer organizations 2. One person each recommended by civic organizations (referring to non-profit private organizations under Article 2 of the Act on Support for Non-Profit Private Organizations; hereinafter the same shall apply), consumer organizations, agricultural and fishing community organizations, and self-employed organizations 3. Eight persons recommended by organizations representing the medical field and organizations representing the pharmaceutical field 4. Eight persons falling under the following categories a. Two public officials belonging to central administrative agencies as determined by Presidential Decree b. One person each recommended by the President of the National Health Insurance Service and the President of the Health Insurance Review and Assessment Service c. Four persons with extensive knowledge and experience in health insurance

심의위원회 위원(제4항제4호가목에 따른 위원은 제외한다)의 임기는 3년으로 한다. 다만, 위원의 사임 등으로 새로 위촉된 위원의 임기는 전임위원 임기의 남은 기간으로 한다.

The term of office for members of the Deliberation Committee (excluding members under paragraph (4) 4 a) shall be three years. However, the term of office for a newly appointed member due to the resignation of a member shall be the remaining period of the term of the former member.

보건복지부장관은 심의위원회가 제1항제5호의2에 따라 심의한 사항을 국회에 보고하여야 한다. <신설 2024.1.9>

The Minister of Health and Welfare shall report the matters deliberated by the Deliberation Committee under Article 1 (5-2) to the National Assembly. <Newly Added by Act No. 19967, Jan. 9, 2024>
