제41조의2 약제에 대한 요양급여비용 상한금액의 감액 등

보건복지부장관은 「약사법」 제47조제2항의 위반과 관련된 제41조제1항제2호의 약제에 대하여는 요양급여비용 상한금액(제41조제3항에 따라 약제별 요양급여비용의 상한으로 정한 금액을 말한다. 이하 같다)의 100분의 20을 넘지 아니하는 범위에서 그 금액의 일부를 감액할 수 있다. <신설 2018.3.27>
The Minister of Health and Welfare may reduce a portion of the upper limit of medical care benefits costs (hereinafter referred to as the "upper limit of medical care benefits costs for each drug," which means the amount determined as the upper limit of medical care benefits costs for each drug pursuant to Article 41 (3)) for drugs falling under Article 41 (1) 2. related to violations of Article 47 (2) of the Pharmaceutical Affairs Act, within the scope not exceeding 20/100 of such amount. <Newly enacted 2018.3.27>
보건복지부장관은 제1항에 따라 요양급여비용의 상한금액이 감액된 약제가 감액된 날부터 5년의 범위에서 대통령령으로 정하는 기간 내에 다시 제1항에 따른 감액의 대상이 된 경우에는 요양급여비용 상한금액의 100분의 40을 넘지 아니하는 범위에서 요양급여비용 상한금액의 일부를 감액할 수 있다. <신설 2018.3.27>
If a drug for which the upper limit of medical care benefits costs has been reduced pursuant to paragraph (1) is again subject to reduction under paragraph (1) within the period prescribed by Presidential Decree within the scope of 5 years from the date of reduction, the Minister of Health and Welfare may reduce a portion of the upper limit of medical care benefits costs within the scope not exceeding 40/100 of the upper limit of medical care benefits costs. <Newly enacted 2018.3.27>
보건복지부장관은 제2항에 따라 요양급여비용의 상한금액이 감액된 약제가 감액된 날부터 5년의 범위에서 대통령령으로 정하는 기간 내에 다시 「약사법」 제47조제2항의 위반과 관련된 경우에는 해당 약제에 대하여 1년의 범위에서 기간을 정하여 요양급여의 적용을 정지할 수 있다. <개정 2018.3.27>
If a drug for which the upper limit of medical care benefits costs has been reduced pursuant to paragraph (2) is again in violation of Article 47 (2) of the Pharmaceutical Affairs Act within the period prescribed by Presidential Decree within the scope of 5 years from the date of reduction, the Minister of Health and Welfare may suspend the application of medical care benefits for the drug for a period determined within the scope of 1 year. <Amended 2018.3.27>
제1항부터 제3항까지의 규정에 따른 요양급여비용 상한금액의 감액 및 요양급여 적용 정지의 기준, 절차, 그 밖에 필요한 사항은 대통령령으로 정한다. <개정 2018.3.27>
The standards, procedures, and other necessary matters concerning the reduction of the upper limit of medical care benefits costs and the suspension of application of medical care benefits pursuant to paragraphs (1) through (3) shall be prescribed by Presidential Decree. <Amended 2018.3.27>
