제41조의3 행위ㆍ치료재료 및 약제에 대한 요양급여대상 여부의 결정 및 조정

제42조에 따른 요양기관, 치료재료의 제조업자ㆍ수입업자 등 보건복지부령으로 정하는 자는 요양급여대상 또는 비급여대상으로 결정되지 아니한 제41조제1항제1호ㆍ제3호ㆍ제4호의 요양급여에 관한 행위 및 제41조제1항제2호의 치료재료(이하 "행위ㆍ치료재료"라 한다)에 대하여 요양급여대상 여부의 결정을 보건복지부장관에게 신청하여야 한다.
A medical care institution under Article 42, a manufacturer or importer of medical supplies, etc., as prescribed by a decree of the Minister of Health and Welfare, shall apply to the Minister of Health and Welfare for a determination of eligibility for medical care benefits for procedures related to medical care benefits under Article 41 (1) 1, 3, and 4, and for medical supplies under Article 41 (1) 2 (hereinafter referred to as "procedures and medical supplies"), which have not yet been determined as eligible or ineligible for medical care benefits.
「약사법」에 따른 약제의 제조업자ㆍ수입업자 등 보건복지부령으로 정하는 자(이하 "약제의 제조업자등"이라 한다)는 요양급여대상에 포함되지 아니한 제41조제1항제2호의 약제(이하 이 조에서 "약제"라 한다)에 대하여 보건복지부장관에게 요양급여대상 여부의 결정을 신청할 수 있다. <개정 2023.5.19>
A manufacturer or importer of pharmaceuticals under the Pharmaceutical Affairs Act, etc., as prescribed by a decree of the Minister of Health and Welfare (hereinafter referred to as "manufacturer, etc. of pharmaceuticals"), may apply to the Minister of Health and Welfare for a determination of eligibility for medical care benefits for pharmaceuticals under Article 41 (1) 2 that are not included in the eligible items for medical care benefits (hereinafter referred to as "pharmaceuticals" in this Article). <Amended by Act No. XXXX, May 19, 2023.>
제1항 및 제2항에 따른 신청을 받은 보건복지부장관은 정당한 사유가 없으면 보건복지부령으로 정하는 기간 이내에 요양급여대상 또는 비급여대상의 여부를 결정하여 신청인에게 통보하여야 한다.
The Minister of Health and Welfare, upon receiving an application under paragraphs ① and ②, shall determine whether an item is eligible or ineligible for medical care benefits and notify the applicant within the period prescribed by a decree of the Minister of Health and Welfare, unless there is a justifiable reason.
보건복지부장관은 제1항 및 제2항에 따른 신청이 없는 경우에도 환자의 진료상 반드시 필요하다고 보건복지부령으로 정하는 경우에는 직권으로 행위ㆍ치료재료 및 약제의 요양급여대상의 여부를 결정할 수 있다.
