제51조 장애인에 대한 특례

공단은 「장애인복지법」에 따라 등록한 장애인인 가입자 및 피부양자에게는 「장애인ㆍ노인 등을 위한 보조기기 지원 및 활용촉진에 관한 법률」 제3조제2호에 따른 보조기기(이하 이 조에서 "보조기기"라 한다)에 대하여 보험급여를 할 수 있다. <개정 2019.4.23>
The Corporation may provide insurance benefits for assistive devices (hereinafter referred to as "assistive devices" in this Article) prescribed in Article 3, Subparagraph 2 of the Act on the Support and Promotion of the Use of Assistive Devices for Persons with Disabilities, the Elderly, etc. to subscribers and their dependents who are registered as persons with disabilities under the 「Act on the Welfare of Persons with Disabilities」. <Amended by Act No. 16302, Apr. 23, 2019>
장애인인 가입자 또는 피부양자에게 보조기기를 판매한 자는 가입자나 피부양자의 위임이 있는 경우 공단에 보험급여를 직접 청구할 수 있다. 이 경우 공단은 지급이 청구된 내용의 적정성을 심사하여 보조기기를 판매한 자에게 보조기기에 대한 보험급여를 지급할 수 있다. <신설 2020.12.29>
A person who sold assistive devices to a subscriber or dependent with a disability may directly claim insurance benefits from the Corporation if authorized by the subscriber or dependent. In such cases, the Corporation may examine the appropriateness of the claimed contents and pay insurance benefits for the assistive devices to the person who sold the assistive devices. <Newly Inserted by Act No. 17721, Dec. 29, 2020>
제1항에 따른 보조기기에 대한 보험급여의 범위ㆍ방법ㆍ절차, 제2항에 따른 보조기기 판매업자의 보험급여 청구, 공단의 적정성 심사 및 그 밖에 필요한 사항은 보건복지부령으로 정한다. <개정 2019.4.23, 2020.12.29>
