심사평가원의 업무를 효율적으로 수행하기 위하여 심사평가원에 진료심사평가위원회(이하 "심사위원회"라 한다)를 둔다.
To efficiently perform the duties of the HIRA, a Medical Review and Assessment Committee (hereinafter referred to as the "Review Committee") shall be established within HIRA.
심사위원회는 위원장을 포함하여 90명 이내의 상근 심사위원과 1천명 이내의 비상근 심사위원으로 구성하며, 진료과목별 분과위원회를 둘 수 있다. <개정 2016.2.3>
The Review Committee shall consist of not more than 90 full-time reviewers, including the chairperson, and not more than 1,000 part-time reviewers, and subcommittees by medical specialty may be established. <Amended by Act No. 13945, Feb. 3, 2016>
제2항에 따른 상근 심사위원은 심사평가원의 원장이 보건복지부령으로 정하는 사람 중에서 임명한다.
Full-time reviewers as referred to in paragraph ② shall be appointed by the President of HIRA from among persons designated by a Presidential Decree of the Ministry of Health and Welfare.
제2항에 따른 비상근 심사위원은 심사평가원의 원장이 보건복지부령으로 정하는 사람 중에서 위촉한다.
Part-time reviewers as referred to in paragraph ② shall be appointed by the President of HIRA from among persons designated by a Presidential Decree of the Ministry of Health and Welfare.
심사평가원의 원장은 심사위원이 다음 각 호의 어느 하나에 해당하면 그 심사위원을 해임 또는 해촉할 수 있다.
1. 신체장애나 정신장애로 직무를 수행할 수 없다고 인정되는 경우
2. 직무상 의무를 위반하거나 직무를 게을리한 경우
3. 고의나 중대한 과실로 심사평가원에 손실이 생기게 한 경우
4. 직무 여부와 관계없이 품위를 손상하는 행위를 한 경우
If a reviewer falls under any of the following subparagraphs, the President of HIRA may dismiss or remove such reviewer from office. 1. If the reviewer is deemed unable to perform their duties due to physical or mental disability. 2. If the reviewer violates their official duties or neglects their duties. 3. If the reviewer causes losses to HIRA due to intent or gross negligence. 4. If the reviewer commits an act that damages their dignity, regardless of whether it is related to their duties.
제1항부터 제5항까지에서 규정한 사항 외에 심사위원회 위원의 자격ㆍ임기 및 심사위원회의 구성ㆍ운영 등에 필요한 사항은 보건복지부령으로 정한다.
Matters necessary for the qualifications, term of office, and composition and operation of the Review Committee, in addition to the matters prescribed in paragraphs ① through ⑤, shall be determined by a Presidential Decree of the Ministry of Health and Welfare.
