제91조 시효

다음 각 호의 권리는 3년 동안 행사하지 아니하면 소멸시효가 완성된다. <개정 2016.3.22>
1. 보험료, 연체금 및 가산금을 징수할 권리
2. 보험료, 연체금 및 가산금으로 과오납부한 금액을 환급받을 권리
3. 보험급여를 받을 권리
4. 보험급여 비용을 받을 권리
5. 제47조제3항 후단에 따라 과다납부된 본인일부부담금을 돌려받을 권리
6. 제61조에 따른 근로복지공단의 권리
Rights under the following subparagraphs shall be extinguished by prescription if not exercised for 3 years. <Amended on March 22, 2016> 1. Right to collect insurance premiums, late fees, and additional charges 2. Right to receive a refund of amounts overpaid as insurance premiums, late fees, and additional charges 3. Right to receive insurance benefits 4. Right to receive insurance benefit expenses 5. Right to receive back copayments overpaid pursuant to the latter part of Article 47 (3) 6. Rights of the Korea Workers' Compensation and Welfare Service under Article 61
제1항에 따른 시효는 다음 각 호의 어느 하나의 사유로 중단된다.
1. 보험료의 고지 또는 독촉
2. 보험급여 또는 보험급여 비용의 청구
The statute of limitations under paragraph (1) shall be interrupted by any of the following grounds: 1. Notification or demand for insurance premiums 2. Claim for insurance benefits or insurance benefit expenses
휴직자등의 보수월액보험료를 징수할 권리의 소멸시효는 제79조제5항에 따라 고지가 유예된 경우 휴직 등의 사유가 끝날 때까지 진행하지 아니한다.
The statute of limitations for the right to collect the monthly salary insurance premiums of persons on leave of absence, etc., shall not commence until the cause of leave of absence, etc., ends, if the notification is suspended pursuant to Article 79 (5).
제1항에 따른 소멸시효기간, 제2항에 따른 시효 중단 및 제3항에 따른 시효 정지에 관하여 이 법에서 정한 사항 외에는 「민법」에 따른다.
Matters not prescribed by this Act concerning the prescription period under paragraph (1), the interruption of the statute of limitations under paragraph (2), and the suspension of the statute of limitations under paragraph (3) shall be governed by the Civil Act.
