제97조 보고와 검사

보건복지부장관은 사용자, 직장가입자 또는 세대주에게 가입자의 이동ㆍ보수ㆍ소득이나 그 밖에 필요한 사항에 관한 보고 또는 서류 제출을 명하거나, 소속 공무원이 관계인에게 질문하게 하거나 관계 서류를 검사하게 할 수 있다.
The Minister of Health and Welfare may order employers, workplace subscribers, or heads of households to report or submit documents concerning the movement, adjustment, income of subscribers, or other necessary matters, or may have affiliated public officials question relevant persons or inspect relevant documents.
보건복지부장관은 요양기관(제49조에 따라 요양을 실시한 기관을 포함한다)에 대하여 요양ㆍ약제의 지급 등 보험급여에 관한 보고 또는 서류 제출을 명하거나, 소속 공무원이 관계인에게 질문하게 하거나 관계 서류를 검사하게 할 수 있다.
The Minister of Health and Welfare may order medical care institutions (including institutions that have provided medical care pursuant to Article 49) to report or submit documents concerning insurance benefits such as medical care and payment for medicines, or may have affiliated public officials question relevant persons or inspect relevant documents.
보건복지부장관은 보험급여를 받은 자에게 해당 보험급여의 내용에 관하여 보고하게 하거나, 소속 공무원이 질문하게 할 수 있다.
The Minister of Health and Welfare may order persons who have received insurance benefits to report on the details of such benefits, or may have affiliated public officials question them.

The Minister of Health and Welfare may order organizations that act on behalf of the claims for review of medical care benefit costs pursuant to Article 47 (7) (hereinafter referred to as "substitute claim organizations") to submit necessary data, or may have affiliated public officials investigate and confirm data related to substitute claims.
보건복지부장관은 제41조의2에 따른 약제에 대한 요양급여비용 상한금액의 감액 및 요양급여의 적용 정지를 위하여 필요한 경우에는 「약사법」 제47조제2항에 따른 의약품공급자에 대하여 금전, 물품, 편익, 노무, 향응, 그 밖의 경제적 이익등 제공으로 인한 의약품 판매 질서 위반 행위에 관한 보고 또는 서류 제출을 명하거나, 소속 공무원이 관계인에게 질문하게 하거나 관계 서류를 검사하게 할 수 있다. <신설 2018.3.27>
The Minister of Health and Welfare may, when necessary for reducing the maximum amount of medical care benefit costs for pharmaceuticals pursuant to Article 41 (2) and suspending the application of medical care benefits, order pharmaceutical suppliers pursuant to the Pharmaceutical Affairs Act, Article 47 (2) to report or submit documents concerning violations of the order of pharmaceutical sales due to the provision of money, goods, benefits, labor, entertainment, or other economic benefits, or may have affiliated public officials question relevant persons or inspect relevant documents.
제1항부터 제5항까지의 규정에 따라 질문ㆍ검사ㆍ조사 또는 확인을 하는 소속 공무원은 그 권한을 표시하는 증표를 지니고 관계인에게 보여주어야 한다. <개정 2018.3.27>
Affiliated public officials who conduct questioning, inspections, investigations, or confirmations pursuant to paragraphs ① through ⑤ shall carry and present identification documents indicating their authority to the relevant persons.
보건복지부장관은 제1항부터 제5항까지에 따른 질문ㆍ검사ㆍ조사 또는 확인 업무를 효율적으로 수행하기 위하여 대통령령으로 정하는 바에 따라 공단 또는 심사평가원으로 하여금 그 업무를 지원하게 할 수 있다. <개정 2024.1.23>
The Minister of Health and Welfare may have the National Health Insurance Service or the Health Insurance Review & Assessment Service support the work of questioning, inspections, investigations, or confirmations pursuant to paragraphs ① through ⑤, as prescribed by Presidential Decree, in order to efficiently perform such work.
제1항부터 제6항까지에 따른 질문ㆍ검사ㆍ조사 또는 확인의 내용ㆍ절차ㆍ방법 등에 관하여 이 법에서 정하는 사항을 제외하고는 「행정조사기본법」에서 정하는 바에 따른다. <신설 2024.1.23>
Matters concerning the content, procedures, methods, etc. of questioning, inspections, investigations, or confirmations pursuant to paragraphs ① through ⑥ shall be governed by the Framework Act on Administrative Investigations, except as otherwise provided in this Act.
