제102조의2 징수심사위원회의 구성ㆍ운영 및 심사 등

법 제109조제1항에 따른 징수심사위원회(이하 "징수심사위원회"라 한다)는 위원장 1명을 포함한 25명의 위원으로 구성한다.
The Collection Review Committee (hereinafter referred to as the "Collection Review Committee") under Article 109(1) of the Act shall be composed of 25 members, including one chairperson.
징수심사위원회의 위원장은 건강보험공단의 상임이사 중에서 건강보험공단의 이사장이 임명하고, 위원은 다음 각 호에 해당하는 사람 중에서 건강보험공단의 이사장이 임명 또는 위촉한다.
1. 건강보험공단의 직원 1명
2. 사용자단체 및 근로자단체가 각각 4명씩 추천하는 8명
3. 시민단체, 소비자단체, 농어업인단체 및 지역가입자를 대표하는 단체가 각각 2명씩 추천하는 8명
4. 변호사, 사회보험 및 의료에 관한 학식과 경험이 풍부한 사람 7명
The chairperson of the Collection Review Committee shall be appointed by the Chairperson of the National Health Insurance Service from among the standing directors of the National Health Insurance Service, and the members shall be appointed or recommended by the Chairperson of the National Health Insurance Service from among the following persons: 1. One employee of the National Health Insurance Service 2. Eight persons, with 4 persons recommended by each of the employer organizations and labor organizations 3. Eight persons, with 2 persons recommended by each of the civic organizations, consumer organizations, agricultural and fishery organizations, and organizations representing regional subscribers 4. Seven persons who are lawyers, or who have extensive knowledge and experience in social insurance and healthcare.
제2항에 따라 위촉된 위원의 임기는 3년으로 한다.
The term of office for members recommended under paragraph (2) shall be 3 years.
징수심사위원회의 운영에 관하여는 「국민건강보험법 시행령」 제55조를 준용한다. 이 경우 "이의신청위원회"는 "징수심사위원회"로 본다. <개정 2012.8.31>
Regarding the operation of the Collection Review Committee, Article 55 of the Enforcement Decree of the National Health Insurance Act shall apply mutatis mutandis. In this case, "Objection Committee" shall be deemed "Collection Review Committee". <Amended Aug. 31, 2012>
징수심사위원회의 심사에 관하여는 제95조부터 제101조까지의 규정을 준용한다. 이 경우 "심사위원회"는 "징수심사위원회"로, "공단"은 "건강보험공단"으로 본다.
Regarding the review of the Collection Review Committee, Articles 95 through 101 shall apply mutatis mutandis. In this case, "Review Committee" shall be deemed "Collection Review Committee", and "the Service" shall be deemed "the National Health Insurance Service".
제1항부터 제5항까지에서 규정한 사항 외에 징수심사위원회의 구성ㆍ운영 및 심사 등에 필요한 사항은 징수심사위원회의 의결을 거쳐 건강보험공단의 규정으로 정한다.
Matters other than those prescribed in paragraphs (1) through (5) that are necessary for the composition, operation, and review of the Collection Review Committee, etc., shall be determined by the regulations of the National Health Insurance Service after deliberation by the Collection Review Committee.
