제66조 조기노령연금의 지급 정지 등

제61조제2항과 제63조제2항에 따라 조기노령연금을 받고 있는 60세 미만인 자가 다음 각 호의 어느 하나에 해당되는 경우에는 그 기간에 해당하는 조기노령연금은 지급을 정지한다. <개정 2011.12.31, 2017.3.21>
1. 제61조제2항에 따른 소득이 있는 업무에 종사하는 경우
2. 제1호에는 해당되지 아니하나 조기노령연금을 받고 있는 본인이 조기노령연금 지급 정지를 신청하는 경우
Where a person under the age of 60 receiving an early old-age pension pursuant to Article 61 (2) and Article 63 (2) falls under any of the following subparagraphs, the early old-age pension corresponding to that period shall be suspended. <Amended by Act No. 11157, Dec. 31, 2011; Act No. 14146, Mar. 21, 2017> 1. Where engaged in work that generates income under Article 61 (2) 2. Where the recipient of the early old-age pension himself/herself, who does not fall under subparagraph 1, applies for the suspension of the early old-age pension payment
제1항에 따라 조기노령연금의 지급이 정지된 자가 다음 각 호의 어느 하나에 해당되는 경우에는 조기노령연금을 다시 지급한다. <신설 2017.3.21>
1. 60세에 도달하는 경우
2. 제1항제1호에 해당하는 자가 60세에 도달하기 전에 제61조제2항에 따른 소득이 있는 업무에 종사하지 아니하는 경우
3. 제1항제2호에 해당하는 자가 60세에 도달하기 전에 제61조제2항에 따른 소득이 있는 업무에 종사하지 아니한 상태에서 본인이 조기노령연금의 재지급을 신청하는 경우
Where a person whose early old-age pension payment has been suspended pursuant to paragraph (1) falls under any of the following subparagraphs, the early old-age pension shall be reinstated. <Newly Inserted by Act No. 14146, Mar. 21, 2017> 1. Upon reaching the age of 60 2. Where a person falling under subparagraph 1 of paragraph (1) is not engaged in work that generates income under Article 61 (2) before reaching the age of 60 3. Where a person falling under subparagraph 2 of paragraph (1) applies for the reinstatement of the early old-age pension payment while not engaged in work that generates income under Article 61 (2) before reaching the age of 60
제1항에 따라 조기노령연금의 지급이 정지된 자가 제2항에 따라 조기노령연금을 다시 지급받을 경우의 조기노령연금액은 다음 각 호와 같다. <개정 2011.12.31, 2015.1.28, 2017.3.21>
1. 지급 정지 전후의 가입기간을 합산하여 산정한 제63조제1항에 따른 노령연금액(부양가족연금액을 제외한다)에 재 수급 당시의 제63조제2항에 따른 연령별 비율에서 기 수급기간 1개월마다 1천분의 5를 뺀 비율을 곱한 금액에 부양가족연금액을 더한 금액
2. 제1호에 따른 조기노령연금액(부양가족연금액을 제외한다. 이하 이 호에서 같다)이 제1항에 따라 지급 정지되기 전의 조기노령연금액보다 적어지는 경우에는 지급 정지되기 전의 조기노령연금액
The amount of the early old-age pension for a person whose early old-age pension payment has been suspended pursuant to paragraph (1) and who receives the early old-age pension again pursuant to paragraph (2) shall be as follows. <Amended by Act No. 11157, Dec. 31, 2011; Act No. 12973, Jan. 28, 2015; Act No. 14146, Mar. 21, 2017> 1. The amount calculated by multiplying the old-age pension amount under Article 63 (1) (excluding the dependent pension amount), calculated by summing the insured periods before and after the suspension of payment, by the ratio by age under Article 63 (2) at the time of re-receipt, less 5/1000 for each month of the period previously received, plus the dependent pension amount. 2. If the early old-age pension amount under subparagraph 1 (excluding the dependent pension amount; hereinafter referred to as 'early old-age pension amount' in this subparagraph) is less than the early old-age pension amount before suspension of payment under paragraph (1), the early old-age pension amount before suspension of payment.
제1항 및 제2항에 따른 조기노령연금 지급 정지 및 재지급 신청에 필요한 세부사항은 보건복지부령으로 정한다. <신설 2017.3.21>
