제88조에 따른 연금보험료의 납부 의무자(이하 이 조에서 "납부 의무자"라 한다)가 국가, 지방자치단체 또는 「공공기관의 운영에 관한 법률」 제4조에 따른 공공기관으로부터 공사ㆍ제조ㆍ구매ㆍ용역 등 대통령령으로 정하는 계약의 대가를 지급받는 경우에는 연금보험료와 그에 따른 연체금 및 체납처분비(이하 이 조에서 "연금보험료등"이라 한다)의 납부사실을 증명하여야 한다. 다만, 납부 의무자가 계약대금의 전부 또는 일부를 체납한 연금보험료로 납부하려는 경우 등 대통령령으로 정하는 경우에는 그러하지 아니하다.
A person obligated to pay pension insurance premiums under Article 88 (hereinafter referred to as "obligated payer" in this Article) who receives payment for the contract price, such as construction, manufacturing, purchase, or services, as prescribed by Presidential Decree, from a state, local government, or public institution under Article 4 of the Act on the Management of Public Institutions, shall prove the payment of pension insurance premiums, late penalties, and collection costs for delinquent payment (hereinafter referred to as "pension insurance premiums, etc." in this Article). Provided, however, that this shall not apply in cases prescribed by Presidential Decree, such as when the obligated payer intends to pay all or part of the contract price with delinquent pension insurance premiums.
납부 의무자가 제1항에 따라 납부사실을 증명하여야 할 경우 제1항의 계약을 담당하는 주무관서 또는 공공기관은 납부 의무자의 동의를 받아 건강보험공단에 조회하여 연금보험료등의 납부여부를 확인하는 것으로 제1항에 따른 납부증명을 갈음할 수 있다.
When the obligated payer is required to prove payment pursuant to paragraph (1), the competent authority or public institution in charge of the contract under paragraph (1) may substitute the proof of payment under paragraph (1) by verifying the payment of pension insurance premiums, etc. by inquiring with the National Health Insurance Service, with the consent of the obligated payer.
