사업주는 근로자(관계수급인의 근로자를 포함한다. 이하 이 조에서 같다)가 신체적 피로와 정신적 스트레스를 해소할 수 있도록 휴식시간에 이용할 수 있는 휴게시설을 갖추어야 한다.
Employers shall provide rest facilities that can be used during break times to relieve the physical fatigue and mental stress of workers (including workers of affiliated subcontractors. Hereinafter the same applies in this Article).
사업주 중 사업의 종류 및 사업장의 상시 근로자 수 등 대통령령으로 정하는 기준에 해당하는 사업장의 사업주는 제1항에 따라 휴게시설을 갖추는 경우 크기, 위치, 온도, 조명 등 고용노동부령으로 정하는 설치ㆍ관리기준을 준수하여야 한다.
Among employers, those whose workplaces meet the standards prescribed by Presidential Decree, such as the type of business and the number of regularly employed workers at the workplace, shall comply with the installation and management standards prescribed by the Ministry of Employment and Labor concerning size, location, temperature, and lighting when providing rest facilities in accordance with paragraph ①.
