제167조 벌칙

제38조제1항부터 제3항까지(제166조의2에서 준용하는 경우를 포함한다), 제39조제1항(제166조의2에서 준용하는 경우를 포함한다) 또는 제63조(제166조의2에서 준용하는 경우를 포함한다)를 위반하여 근로자를 사망에 이르게 한 자는 7년 이하의 징역 또는 1억원 이하의 벌금에 처한다. <개정 2020.3.31>
Any person who causes the death of a worker in violation of Article 38(1) through (3) (including cases applied mutatis mutandis by Article 166(2)), Article 39(1) (including cases applied mutatis mutandis by Article 166(2)), or Article 63 (including cases applied mutatis mutandis by Article 166(2)) shall be punished by imprisonment for not more than 7 years or a fine of not more than 100 million won. <Amended by Act No. 17193, Mar. 31. 2020>
제1항의 죄로 형을 선고받고 그 형이 확정된 후 5년 이내에 다시 제1항의 죄를 저지른 자는 그 형의 2분의 1까지 가중한다. <개정 2020.5.26>
Any person who commits the offense under paragraph (1) again within 5 years after receiving a sentence for the offense under paragraph (1) and the sentence has become final and conclusive shall be subject to an aggravated sentence up to one-half of the original sentence. <Amended by Act No. 17235, May 26. 2020>
