제169조 벌칙

1. 제44조제1항 후단, 제63조(제166조의2에서 준용하는 경우를 포함한다), 제76조, 제81조, 제82조제2항, 제84조제1항, 제87조제1항, 제118조제3항, 제123조제1항, 제139조제1항 또는 제140조제1항(제166조의2에서 준용하는 경우를 포함한다)을 위반한 자
2. 제45조제1항 후단, 제46조제5항, 제53조제1항(제166조의2에서 준용하는 경우를 포함한다), 제87조제2항, 제118조제4항, 제119조제4항 또는 제131조제1항(제166조의2에서 준용하는 경우를 포함한다)에 따른 명령을 위반한 자
3. 제58조제3항 또는 같은 조 제5항 후단(제59조제2항에 따라 준용되는 경우를 포함한다)에 따른 안전 및 보건에 관한 평가 업무를 제165조제2항에 따라 위탁받은 자로서 그 업무를 거짓이나 그 밖의 부정한 방법으로 수행한 자
4. 제84조제1항 및 제3항에 따른 안전인증 업무를 제165조제2항에 따라 위탁받은 자로서 그 업무를 거짓이나 그 밖의 부정한 방법으로 수행한 자
5. 제93조제1항에 따른 안전검사 업무를 제165조제2항에 따라 위탁받은 자로서 그 업무를 거짓이나 그 밖의 부정한 방법으로 수행한 자
6. 제98조에 따른 자율검사프로그램에 따른 안전검사 업무를 거짓이나 그 밖의 부정한 방법으로 수행한 자
Any person who falls under any of the following subparagraphs shall be punished by imprisonment of not more than 3 years or a fine of not more than 30 million won. <Amended by Act No. 17207, Mar. 31, 2020> 1. Any person who violates Article 44 (1) proviso, Article 63 (including cases applied mutatis mutandis by Article 166-2), Article 76, Article 81, Article 82 (2), Article 84 (1), Article 87 (1), Article 118 (3), Article 123 (1), Article 139 (1), or Article 140 (1) (including cases applied mutatis mutandis by Article 166-2). 2. Any person who violates an order pursuant to Article 45 (1) proviso, Article 46 (5), Article 53 (1) (including cases applied mutatis mutandis by Article 166-2), Article 87 (2), Article 118 (4), Article 119 (4), or Article 131 (1) (including cases applied mutatis mutandis by Article 166-2). 3. Any person entrusted with the safety and health assessment business under Article 58 (3) or the proviso to Article 58 (5) (including cases applied mutatis mutandis by Article 59 (2)) pursuant to Article 165 (2), who performs such business by false or other dishonest means. 4. Any person entrusted with the safety certification business under Article 84 (1) and (3) pursuant to Article 165 (2), who performs such business by false or other dishonest means. 5. Any person entrusted with the safety inspection business under Article 93 (1) pursuant to Article 165 (2), who performs such business by false or other dishonest means. 6. Any person who performs the safety inspection business under the self-inspection program pursuant to Article 98 by false or other dishonest means.
