Article 39 (Health Measures)

제39조 보건조치

사업주는 다음 각 호의 어느 하나에 해당하는 건강장해를 예방하기 위하여 필요한 조치(이하 "보건조치"라 한다)를 하여야 한다. <개정 2024.10.22>

  1. 1. 원재료ㆍ가스ㆍ증기ㆍ분진ㆍ흄(fume, 열이나 화학반응에 의하여 형성된 고체증기가 응축되어 생긴 미세입자를 말한다)ㆍ미스트(mist, 공기 중에 떠다니는 작은 액체방울을 말한다)ㆍ산소결핍ㆍ병원체 등에 의한 건강장해

  2. 2. 방사선ㆍ유해광선ㆍ고열ㆍ한랭ㆍ초음파ㆍ소음ㆍ진동ㆍ이상기압 등에 의한 건강장해

  3. 3. 사업장에서 배출되는 기체ㆍ액체 또는 찌꺼기 등에 의한 건강장해

  4. 4. 계측감시(計測監視), 컴퓨터 단말기 조작, 정밀공작(精密工作) 등의 작업에 의한 건강장해

  5. 5. 단순반복작업 또는 인체에 과도한 부담을 주는 작업에 의한 건강장해

  6. 6. 환기ㆍ채광ㆍ조명ㆍ보온ㆍ방습ㆍ청결 등의 적정기준을 유지하지 아니하여 발생하는 건강장해

  7. 7. 폭염ㆍ한파에 장시간 작업함에 따라 발생하는 건강장해

An employer shall take necessary measures (hereinafter referred to as "health measures") to prevent health impairments falling under any of the following subparagraphs. <Amended by Act No. XXXX, Oct. 22, 2024> 1. Health impairments due to raw materials, gas, vapor, dust, fume (referring to fine particles formed by condensation of heat or chemical reaction), mist (referring to small liquid droplets suspended in the air), oxygen deficiency, pathogens, etc. 2. Health impairments due to radiation, harmful rays, high temperature, cold, ultrasound, noise, vibration, abnormal pressure, etc. 3. Health impairments due to gases, liquids, or residues, etc., discharged from the workplace. 4. Health impairments due to work such as measurement and monitoring, computer terminal operation, precision work, etc. 5. Health impairments due to simple repetitive tasks or tasks that impose excessive burden on the human body. 6. Health impairments arising from failure to maintain appropriate standards for ventilation, daylighting, lighting, insulation, moisture-proofing, cleanliness, etc. 7. Health impairments arising from long-term work during heat waves or cold spells.

제1항에 따라 사업주가 하여야 하는 보건조치에 관한 구체적인 사항은 고용노동부령으로 정한다.

Specific matters concerning the health measures that an employer must take under paragraph ① shall be prescribed by the Ordinance of the Ministry of Employment and Labor.
