제92조 자율안전확인대상기계등의 제조 등의 금지 등

누구든지 다음 각 호의 어느 하나에 해당하는 자율안전확인대상기계등을 제조ㆍ수입ㆍ양도ㆍ대여ㆍ사용하거나 양도ㆍ대여의 목적으로 진열할 수 없다.
1. 제89조제1항 각 호 외의 부분 본문에 따른 신고를 하지 아니한 경우(같은 항 각 호 외의 부분 단서에 따라 신고가 면제되는 경우는 제외한다)
2. 거짓이나 그 밖의 부정한 방법으로 제89조제1항 각 호 외의 부분 본문에 따른 신고를 한 경우
3. 자율안전확인대상기계등의 안전에 관한 성능이 자율안전기준에 맞지 아니하게 된 경우
4. 제91조제1항에 따라 자율안전확인표시의 사용 금지 명령을 받은 경우
No person shall manufacture, import, transfer, lend, use, or display for the purpose of transfer or lending, self-safety confirmation target machines, etc. falling under any of the following subparagraphs: 1. Where the report under the main clause of Article 89 (1) has not been filed (excluding cases where the report is exempted under the proviso to the main clause of the same paragraph) 2. Where the report under the main clause of Article 89 (1) has been filed by false or other fraudulent means 3. Where the safety performance of self-safety confirmation target machines, etc. does not meet the self-safety standards 4. Where an order to prohibit the use of the self-safety confirmation mark has been received under Article 91 (1)
고용노동부장관은 제1항을 위반하여 자율안전확인대상기계등을 제조ㆍ수입ㆍ양도ㆍ대여하는 자에게 고용노동부령으로 정하는 바에 따라 그 자율안전확인대상기계등을 수거하거나 파기할 것을 명할 수 있다.
The Minister of Employment and Labor may order the collection or destruction of self-safety confirmation target machines, etc. from a person who manufactures, imports, transfers, or lends such machines, etc. in violation of paragraph (1), in accordance with the provisions of the Ministry of Employment and Labor Ordinance.
