Article 98 (Safety Inspection Based on Self-Inspection Program)
제98조 자율검사프로그램에 따른 안전검사

제93조제1항에도 불구하고 같은 항에 따라 안전검사를 받아야 하는 사업주가 근로자대표와 협의(근로자를 사용하지 아니하는 경우는 제외한다)하여 같은 항 전단에 따른 검사기준, 같은 조 제3항에 따른 검사 주기 등을 충족하는 검사프로그램(이하 "자율검사프로그램"이라 한다)을 정하고 고용노동부장관의 인정을 받아 다음 각 호의 어느 하나에 해당하는 사람으로부터 자율검사프로그램에 따라 안전검사대상기계등에 대하여 안전에 관한 성능검사(이하 "자율안전검사"라 한다)를 받으면 안전검사를 받은 것으로 본다.
1. 고용노동부령으로 정하는 안전에 관한 성능검사와 관련된 자격 및 경험을 가진 사람
2. 고용노동부령으로 정하는 바에 따라 안전에 관한 성능검사 교육을 이수하고 해당 분야의 실무 경험이 있는 사람
Notwithstanding Article 93(1), if an employer subject to safety inspection under the same paragraph establishes an inspection program (hereinafter referred to as "Self-Inspection Program") that meets the inspection standards under the same paragraph, first part, and the inspection cycle under the same Article, paragraph 3, in consultation with the workers' representative (excluding cases where no workers are employed), and obtains approval from the Minister of Employment and Labor, the employer shall be deemed to have received safety inspection upon receiving a performance inspection regarding safety (hereinafter referred to as "Self-Safety Inspection") for the machinery, etc. subject to safety inspection, based on the Self-Inspection Program, from a person falling under any of the following subparagraphs: 1. A person with qualifications and experience related to performance inspection regarding safety as prescribed by the Ordinance of the Ministry of Employment and Labor 2. A person who has completed safety performance inspection training and has practical experience in the relevant field, as prescribed by the Ordinance of the Ministry of Employment and Labor
자율검사프로그램의 유효기간은 2년으로 한다.
The validity period of a Self-Inspection Program shall be two years.
사업주는 자율안전검사를 받은 경우에는 그 결과를 기록하여 보존하여야 한다.
If an employer receives a Self-Safety Inspection, they shall record and preserve the results.
자율안전검사를 받으려는 사업주는 제100조에 따라 지정받은 검사기관(이하 "자율안전검사기관"이라 한다)에 자율안전검사를 위탁할 수 있다.
An employer intending to receive a Self-Safety Inspection may entrust the Self-Safety Inspection to an inspection agency designated under Article 100 (hereinafter referred to as a "Self-Safety Inspection Agency").
자율검사프로그램에 포함되어야 할 내용, 자율검사프로그램의 인정 요건, 인정 방법 및 절차, 그 밖에 필요한 사항은 고용노동부령으로 정한다.
The contents to be included in a Self-Inspection Program, the requirements for approval of a Self-Inspection Program, the methods and procedures for approval, and other necessary matters shall be prescribed by the Ordinance of the Ministry of Employment and Labor.
