제99조 자율검사프로그램 인정의 취소 등

고용노동부장관은 자율검사프로그램의 인정을 받은 자가 다음 각 호의 어느 하나에 해당하는 경우에는 자율검사프로그램의 인정을 취소하거나 인정받은 자율검사프로그램의 내용에 따라 검사를 하도록 하는 등 시정을 명할 수 있다. 다만, 제1호의 경우에는 인정을 취소하여야 한다.
1. 거짓이나 그 밖의 부정한 방법으로 자율검사프로그램을 인정받은 경우
2. 자율검사프로그램을 인정받고도 검사를 하지 아니한 경우
3. 인정받은 자율검사프로그램의 내용에 따라 검사를 하지 아니한 경우
4. 제98조제1항 각 호의 어느 하나에 해당하는 사람 또는 자율안전검사기관이 검사를 하지 아니한 경우
The Minister of Employment and Labor may revoke the recognition of a self-inspection program or order corrective measures, such as conducting inspections according to the content of the recognized self-inspection program, if a person who has received recognition of a self-inspection program falls under any of the following subparagraphs. However, in the case of subparagraph 1, the recognition shall be revoked. 1. When recognition of the self-inspection program was obtained by fraud or other dishonest means 2. When an inspection was not conducted despite having received recognition of the self-inspection program 3. When an inspection was not conducted according to the content of the recognized self-inspection program 4. When a person falling under any of the subparagraphs of Article 98 (1) or a self-safety inspection agency did not conduct an inspection.
사업주는 제1항에 따라 자율검사프로그램의 인정이 취소된 안전검사대상기계등을 사용해서는 아니 된다.
An employer shall not use machinery, etc., subject to safety inspection for which the recognition of the self-inspection program has been revoked pursuant to paragraph ①.
