Article 42 (Disqualification, Recusal, and Avoidance of Members)
제42조 위원의 제척ㆍ기피ㆍ회피

분쟁조정위원회의 위원은 다음 각 호의 어느 하나에 해당하는 경우에는 제43조제1항에 따라 분쟁조정위원회에 신청된 분쟁조정사건(이하 이 조에서 "사건"이라 한다)의 심의ㆍ의결에서 제척(除斥)된다.
1. 위원 또는 그 배우자나 배우자였던 자가 그 사건의 당사자가 되거나 그 사건에 관하여 공동의 권리자 또는 의무자의 관계에 있는 경우
2. 위원이 그 사건의 당사자와 친족이거나 친족이었던 경우
3. 위원이 그 사건에 관하여 증언, 감정, 법률자문을 한 경우
4. 위원이 그 사건에 관하여 당사자의 대리인으로서 관여하거나 관여하였던 경우
A member of the Dispute Mediation Committee shall be disqualified from deliberation and resolution of a dispute mediation case applied to the Dispute Mediation Committee pursuant to Article 43(1) (hereinafter referred to as "case" in this Article) if the member falls under any of the following subparagraphs. 1. Where the member, or his or her spouse or former spouse, is a party to the case or has a relationship as a joint right holder or obligor with respect to the case 2. Where the member is or was a relative of a party to the case 3. Where the member has given testimony, conducted an appraisal, or provided legal advice concerning the case 4. Where the member has participated or participated in the past as an agent for a party to the case
당사자는 위원에게 공정한 심의ㆍ의결을 기대하기 어려운 사정이 있으면 위원장에게 기피신청을 할 수 있다. 이 경우 위원장은 기피신청에 대하여 분쟁조정위원회의 의결을 거치지 아니하고 결정한다.
A party may apply for the recusal of a member to the chairperson if there are circumstances where fair deliberation and resolution cannot be expected from the member. In this case, the chairperson shall decide on the recusal application without the resolution of the Dispute Mediation Committee.
위원이 제1항 또는 제2항의 사유에 해당하는 경우에는 스스로 그 사건의 심의ㆍ의결에서 회피할 수 있다.
If a member falls under the grounds specified in paragraph ① or ②, the member may voluntarily avoid deliberation and resolution of the case.
