제71조 벌칙

1. 제17조제1항제2호에 해당하지 아니함에도 같은 항 제1호(제26조제8항에 따라 준용되는 경우를 포함한다)를 위반하여 정보주체의 동의를 받지 아니하고 개인정보를 제3자에게 제공한 자 및 그 사정을 알면서도 개인정보를 제공받은 자
2. 제18조제1항ㆍ제2항, 제27조제3항 또는 제28조의2(제26조제8항에 따라 준용되는 경우를 포함한다), 제19조 또는 제26조제5항을 위반하여 개인정보를 이용하거나 제3자에게 제공한 자 및 그 사정을 알면서도 영리 또는 부정한 목적으로 개인정보를 제공받은 자
3. 제22조의2제1항(제26조제8항에 따라 준용되는 경우를 포함한다)을 위반하여 법정대리인의 동의를 받지 아니하고 만 14세 미만인 아동의 개인정보를 처리한 자
4. 제23조제1항(제26조제8항에 따라 준용되는 경우를 포함한다)을 위반하여 민감정보를 처리한 자
5. 제24조제1항(제26조제8항에 따라 준용되는 경우를 포함한다)을 위반하여 고유식별정보를 처리한 자
6. 제28조의3제1항(제26조제8항에 따라 준용되는 경우를 포함한다)을 위반하여 보호위원회 또는 관계 중앙행정기관의 장으로부터 전문기관으로 지정받지 아니하고 가명정보를 결합한 자
7. 제28조의3제2항(제26조제8항에 따라 준용되는 경우를 포함한다)을 위반하여 전문기관의 장의 승인을 받지 아니하고 결합을 수행한 기관 외부로 결합된 정보를 반출하거나 이를 제3자에게 제공한 자 및 그 사정을 알면서도 영리 또는 부정한 목적으로 결합된 정보를 제공받은 자
8. 제28조의5제1항(제26조제8항에 따라 준용되는 경우를 포함한다)을 위반하여 특정 개인을 알아보기 위한 목적으로 가명정보를 처리한 자
9. 제59조제2호를 위반하여 업무상 알게 된 개인정보를 누설하거나 권한 없이 다른 사람이 이용하도록 제공한 자 및 그 사정을 알면서도 영리 또는 부정한 목적으로 개인정보를 제공받은 자
10. 제59조제3호를 위반하여 다른 사람의 개인정보를 이용, 훼손, 멸실, 변경, 위조 또는 유출한 자
Any person falling under any of the following subparagraphs shall be punished by imprisonment of not more than five years or a fine of not more than fifty million won. <Amended by Act No. 13967, Mar. 29, 2016, Act No. 17193, Feb. 4, 2020, Act No. 19234, Mar. 14, 2023> 1. A person who provides personal information to a third party without the consent of the data subject in violation of subparagraph 1 of Article 17 (including cases where applied mutatis mutandis under Article 26 (8)), despite not falling under subparagraph 2 of the same paragraph, and a person who receives the personal information while knowing such circumstances. 2. A person who uses or provides personal information to a third party in violation of Article 18 (1) and (2), Article 27 (3), Article 28-2 (including cases where applied mutatis mutandis under Article 26 (8)), Article 19, or Article 26 (5), and a person who receives the personal information for commercial or illicit purposes while knowing such circumstances. 3. A person who processes the personal information of a child under 14 years of age without the consent of a legal representative in violation of Article 22-2 (1) (including cases where applied mutatis mutandis under Article 26 (8)). 4. A person who processes sensitive information in violation of Article 23 (1) (including cases where applied mutatis mutandis under Article 26 (8)). 5. A person who processes resident registration numbers or other unique identification information in violation of Article 24 (1) (including cases where applied mutatis mutandis under Article 26 (8)). 6. A person who combines pseudonymized information without being designated as a specialized institution by the Personal Information Protection Commission or the head of the relevant central administrative agency in violation of Article 28-3 (1) (including cases where applied mutatis mutandis under Article 26 (8)). 7. A person who transfers combined information outside the institution that performed the combination without the approval of the head of the specialized institution, or provides it to a third party, in violation of Article 28-3 (2) (including cases where applied mutatis mutandis under Article 26 (8)), and a person who receives the combined information for commercial or illicit purposes while knowing such circumstances. 8. A person who processes pseudonymized information for the purpose of identifying a specific individual in violation of Article 28-5 (1) (including cases where applied mutatis mutandis under Article 26 (8)). 9. A person who discloses personal information learned in the course of business or provides it to another person for unauthorized use, in violation of Article 59 (2), and a person who receives the personal information for commercial or illicit purposes while knowing such circumstances. 10. A person who uses, damages, destroys, alters, forges, or leaks another person's personal information in violation of Article 59 (3).
