제20조 다른 법률에 따른 인가ㆍ허가 등의 의제

농지에 대하여 제11조에 따라 토지거래계약 허가를 받은 경우에는 「농지법」 제8조에 따른 농지취득자격증명을 받은 것으로 본다. 이 경우 시장ㆍ군수 또는 구청장은 「농업ㆍ농촌 및 식품산업 기본법」 제3조제5호에 따른 농촌(「국토의 계획 및 이용에 관한 법률」에 따른 도시지역의 경우에는 같은 법에 따른 녹지지역만 해당한다)의 농지에 대하여 토지거래계약을 허가하는 경우에는 농지취득자격증명의 발급 요건에 적합한지를 확인하여야 하며, 허가한 내용을 농림축산식품부장관에게 통보하여야 한다.
If permission for a land transaction contract has been granted pursuant to Article 11 for agricultural land, it shall be deemed that a certificate of qualification for acquisition of agricultural land has been obtained pursuant to Article 8 of the 「Act on the Management of Agricultural and Fishing Villages and Food Industry」. In this case, the mayor, county governor, or head of a district (hereinafter referred to as "mayor/county governor/district head") shall, when granting permission for a land transaction contract for agricultural land in a rural area as defined in Article 3, Subparagraph 5 of the 「Framework Act on Agriculture and Rural Communities and Food Industry」 (in the case of an urban area under the 「Act on Land Use and Planning and Control」, only the green-belt area under the same Act shall apply), verify whether it meets the requirements for issuing a certificate of qualification for acquisition of agricultural land, and shall notify the Minister of Agriculture, Food and Rural Affairs of the details of the granted permission.
제11조제4항 및 제5항에 따라 허가증을 발급받은 경우에는 「부동산등기 특별조치법」 제3조에 따른 검인을 받은 것으로 본다.
