제108조 기능검정

시ㆍ도경찰청장은 전문학원의 학감으로 하여금 대통령령으로 정하는 바에 따라 해당 전문학원의 교육생을 대상으로 제83조제1항제4호 및 같은 조 제2항에 따른 운전기능 또는 도로에서 운전하는 능력이 있는지에 관한 검정(이하 "기능검정"이라 한다)을 하게 할 수 있다. <개정 2020.12.22>
The head of a Provincial Police Agency may have the academic dean of a vocational driving school conduct a test to determine whether the trainees of the vocational driving school possess the driving skills or the ability to drive on roads as prescribed in Article 83(1)4 and Article 83(2) (hereinafter referred to as "skills test"), in accordance with the Presidential Decree.
전문학원의 학감은 기능검정원으로 하여금 다음 각 호의 어느 하나에 해당하는 사람을 대상으로 행정안전부령으로 정하는 바에 따라 기능검정을 하게 하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>
1. 학과교육과 제83조제1항제4호에 따른 자동차등의 운전에 관하여 필요한 기능을 익히기 위한 기능교육(이하 "장내기능교육"이라 한다)을 수료한 사람
2. 제83조제2항에 따른 도로에서 운전하는 능력을 익히기 위한 기능교육(이하 "도로주행교육"이라 한다)을 수료한 사람
The academic dean of a vocational driving school shall have a skills tester conduct a skills test, in accordance with the Ordinance of the Ministry of the Interior and Safety, on persons who fall under any of the following subparagraphs: 1. A person who has completed academic education and skills training for learning the skills necessary for driving a motor vehicle, etc. as prescribed in Article 83(1)4 (hereinafter referred to as "course skills training"). 2. A person who has completed skills training for learning the ability to drive on roads as prescribed in Article 83(2) (hereinafter referred to as "road driving training").
전문학원의 학감은 기능검정원이 아닌 사람으로 하여금 기능검정을 하게 하여서는 아니 된다.
The academic dean of a vocational driving school shall not have a person other than a skills tester conduct a skills test.
기능검정원은 자기가 실시한 기능검정에 합격한 사람에게 그 합격 사실을 행정안전부령으로 정하는 바에 따라 서면(書面)으로 증명하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>
A skills tester shall, in accordance with the Ordinance of the Ministry of the Interior and Safety, provide written certification of passing to a person who has passed the skills test conducted by the skills tester.
전문학원의 학감은 제4항에 따라 기능검정원이 합격 사실을 서면으로 증명한 사람에게는 기능검정의 종류별로 행정안전부령으로 정하는 바에 따라 수료증 또는 졸업증을 발급하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>
The academic dean of a vocational driving school shall issue a certificate of completion or a diploma, in accordance with the Ordinance of the Ministry of the Interior and Safety, for each type of skills test to a person for whom a skills tester has provided written certification of passing in accordance with paragraph ④.
