제13조의2 자전거등의 통행방법의 특례

자전거등의 운전자는 자전거도로(제15조제1항에 따라 자전거만 통행할 수 있도록 설치된 전용차로를 포함한다. 이하 이 조에서 같다)가 따로 있는 곳에서는 그 자전거도로로 통행하여야 한다. <개정 2020.6.9>
Drivers of bicycles, etc. shall pass on the bicycle road (including exclusive lanes designated for bicycles only pursuant to Article 15 (1); hereinafter the same applies in this Article) when a bicycle road is separately provided. <Amended by Act No. 17365, Jun. 9, 2020>
자전거등의 운전자는 자전거도로가 설치되지 아니한 곳에서는 도로 우측 가장자리에 붙어서 통행하여야 한다. <개정 2020.6.9>

자전거등의 운전자는 제1항 및 제13조제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 보도를 통행할 수 있다. 이 경우 자전거등의 운전자는 보도 중앙으로부터 차도 쪽 또는 안전표지로 지정된 곳으로 서행하여야 하며, 보행자의 통행에 방해가 될 때에는 일시정지하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2018.3.27, 2020.6.9>
1. 어린이, 노인, 그 밖에 행정안전부령으로 정하는 신체장애인이 자전거를 운전하는 경우. 다만, 「자전거 이용 활성화에 관한 법률」 제2조제1호의2에 따른 전기자전거의 원동기를 끄지 아니하고 운전하는 경우는 제외한다.

3. 도로의 파손, 도로공사나 그 밖의 장애 등으로 도로를 통행할 수 없는 경우
Notwithstanding paragraphs ① and Article 13 (1), drivers of bicycles, etc. may pass on the sidewalk in any of the following cases. When children, the elderly, or persons with physical disabilities as prescribed by the Ordinance of the Ministry of Public Administration and Security are driving bicycles. Provided, That this shall not apply to cases where electric bicycles, as defined in Article 2 (1) (1/2) of the Act on the Promotion of Bicycle Use, are driven without turning off the motor. 2. When passage of bicycles, etc. is permitted by traffic signs. 3. When the road cannot be passed due to damage to the road, road construction, or other obstacles.
자전거등의 운전자는 안전표지로 통행이 허용된 경우를 제외하고는 2대 이상이 나란히 차도를 통행하여서는 아니 된다. <개정 2020.6.9>
