제138조 운전면허증등의 보관

경찰공무원은 자동차등의 운전자가 다음 각 호의 어느 하나에 해당하는 경우에는 현장에서 제164조에 따른 범칙금 납부통고서 또는 출석지시서를 발급하고, 운전면허증등의 제출을 요구하여 이를 보관할 수 있다. 이 경우 그 범칙금 납부통고서 또는 출석지시서에 운전면허증등의 보관 사실을 기록하여야 한다. <개정 2021.10.19>
1. 교통사고를 일으킨 경우
2. 제93조에 따른 운전면허의 취소처분 또는 정지처분의 대상이 된다고 인정되는 경우
3. 제96조에 따라 외국에서 발급한 국제운전면허증 또는 상호인정외국면허증을 가진 사람으로서 제162조제1항에 따른 범칙행위를 한 경우
A police officer may request the submission of a driver's license, etc., and take custody thereof, while issuing a notice of violation payment or a summons to appear under Article 164 on the spot, if a driver of a motor vehicle, etc. falls under any of the following subparagraphs. In this case, the fact of taking custody of the driver's license, etc. shall be recorded on the notice of violation payment or the summons to appear. <Amended by Act No. 18541, Oct. 19, 2021> 1. When an accident has occurred. 2. When it is recognized that the person is subject to a revocation or suspension of driver's license under Article 93. 3. When a person holding an international driver's license or a foreign license recognized by mutual agreement issued in a foreign country under Article 96 commits a violation under Article 162 (1).
제1항의 범칙금 납부통고서 또는 출석지시서는 범칙금의 납부기일이나 출석기일까지 운전면허증등(연습운전면허증은 제외한다)과 같은 효력이 있다.
The notice of violation payment or the summons to appear under paragraph (1) shall have the same effect as a driver's license, etc. (excluding a learner's permit) until the payment deadline for the violation fine or the date for appearance.
자치경찰공무원이 제1항에 따라 운전면허증등을 보관한 경우에는 지체 없이 관할 경찰서장에게 운전면허증등을 첨부하여 그 사실을 통보하여야 한다.
If a local police officer takes custody of a driver's license, etc. under paragraph (1), the officer shall promptly notify the chief of the competent police station thereof, attaching the driver's license, etc.
