제153조 벌칙

다음 각 호의 어느 하나에 해당하는 사람은 6개월 이하의 징역이나 200만원 이하의 벌금 또는 구류에 처한다. <개정 2015.8.11>
1. 제40조를 위반하여 정비불량차를 운전하도록 시키거나 운전한 사람
2. 제41조, 제47조 또는 제58조에 따른 경찰공무원의 요구ㆍ조치 또는 명령에 따르지 아니하거나 이를 거부 또는 방해한 사람
3. 제46조의2를 위반하여 교통단속을 회피할 목적으로 교통단속용 장비의 기능을 방해하는 장치를 제작ㆍ수입ㆍ판매 또는 장착한 사람
4. 제49조제1항제4호를 위반하여 교통단속용 장비의 기능을 방해하는 장치를 한 차를 운전한 사람
5. 제55조를 위반하여 교통사고 발생 시의 조치 또는 신고 행위를 방해한 사람
6. 제68조제1항을 위반하여 함부로 교통안전시설이나 그 밖에 그와 비슷한 인공구조물을 설치한 사람
7. 제80조제3항 또는 제4항에 따른 조건을 위반하여 운전한 사람
A person who falls under any of the following subparagraphs shall be punished by imprisonment for not more than 6 months, a fine not exceeding 2 million won, or detention. <Amended by Act No. 13441, Aug. 11, 2015> 1. A person who causes or drives a vehicle not in good repair in violation of Article 40. 2. A person who fails to comply with, refuses, or obstructs a request, measure, or order by a police official under Articles 41, 47, or 58. 3. A person who manufactures, imports, sells, or installs a device to interfere with the function of traffic enforcement equipment for the purpose of evading traffic enforcement, in violation of Article 46-2. 4. A person who drives a vehicle equipped with a device to interfere with the function of traffic enforcement equipment, in violation of Article 49 (1) 4. 5. A person who obstructs the actions or reporting of acts in case of a traffic accident, in violation of Article 55. 6. A person who carelessly installs traffic safety facilities or other similar artificial structures, in violation of Article 68 (1). 7. A person who drives a vehicle in violation of the conditions under Article 80 (3) or (4).
다음 각 호의 어느 하나에 해당하는 사람은 100만원 이하의 벌금 또는 구류에 처한다. <신설 2015.8.11, 2020.6.9>
1. 고속도로, 자동차전용도로, 중앙분리대가 있는 도로에서 제13조제3항을 고의로 위반하여 운전한 사람
2. 제17조제3항을 위반하여 제17조제1항 및 제2항에 따른 최고속도보다 시속 100킬로미터를 초과한 속도로 자동차등을 운전한 사람
A person who falls under any of the following subparagraphs shall be punished by a fine not exceeding 1 million won or detention. <Newly Inserted by Act No. 13441, Aug. 11, 2015, Act No. 17349, Jun. 9, 2020> 1. A person who intentionally drives a vehicle in violation of Article 13 (3) on a highway, a road exclusively for automobiles, or a road with a median strip. 2. A person who drives a motor vehicle, etc. at a speed exceeding 100 kilometers per hour over the maximum speed under Articles 17 (1) and (2), in violation of Article 17 (3).
