Article 36 (Delegation of Towing and Custody Duties of Vehicles, etc.)
제36조 차의 견인 및 보관업무 등의 대행

경찰서장이나 시장등은 제35조에 따라 견인하도록 한 차의 견인ㆍ보관 및 반환 업무의 전부 또는 일부를 그에 필요한 인력ㆍ시설ㆍ장비 등 자격요건을 갖춘 법인ㆍ단체 또는 개인(이하 "법인등"이라 한다)으로 하여금 대행하게 할 수 있다.
A police station chief or mayor, etc. may delegate all or part of the duties of towing, custody, and return of vehicles towed pursuant to Article 35 to a corporation, organization, or individual that meets the qualification requirements such as necessary personnel, facilities, and equipment (hereinafter referred to as "corporation, etc.").
제1항에 따라 차의 견인ㆍ보관 및 반환 업무를 대행하는 법인등이 갖추어야 하는 인력ㆍ시설 및 장비 등의 요건과 그 밖에 업무의 대행에 필요한 사항은 대통령령으로 정한다.
The requirements for personnel, facilities, and equipment that a corporation, etc. undertaking the duties of towing, custody, and return of vehicles pursuant to Paragraph ① must meet, and other matters necessary for the delegation of duties, shall be determined by Presidential Decree.
경찰서장이나 시장등은 제1항에 따라 차의 견인ㆍ보관 및 반환 업무를 대행하게 하는 경우에는 그 업무의 수행에 필요한 조치와 교육을 명할 수 있다.
When a police station chief or mayor, etc. delegates the duties of towing, custody, and return of vehicles pursuant to Paragraph ①, they may order the necessary measures and training for the performance of such duties.
제1항에 따라 차의 견인ㆍ보관 및 반환 업무를 대행하는 법인등의 담당 임원 및 직원은 「형법」 제129조부터 제132조까지의 규정을 적용할 때에는 공무원으로 본다.
When applying Articles 129 through 132 of the Criminal Act, the officers and employees of a corporation, etc. undertaking the duties of towing, custody, and return of vehicles pursuant to Paragraph ① shall be deemed public officials.
