Article 72 (Preventive Measures Against Danger from Above-Ground Artificial Structures on Roads, etc.)
제72조 도로의 지상 인공구조물 등에 대한 위험방지 조치

경찰서장은 도로의 지상(地上) 인공구조물이나 그 밖의 시설 또는 물건이 교통에 위험을 일으키게 하거나 교통에 뚜렷이 방해될 우려가 있으면 그 인공구조물 등의 소유자ㆍ점유자 또는 관리자에게 그것을 제거하도록 하거나 그 밖에 교통안전에 필요한 조치를 명할 수 있다.
A police station chief may order the owner, possessor, or manager of an above-ground artificial structure or other facility or object on a road to remove it, or may order other necessary measures for traffic safety, if there is a risk of such structure, facility, or object causing danger to traffic or significantly hindering traffic.
경찰서장은 인공구조물 등의 소유자ㆍ점유자 또는 관리자의 성명ㆍ주소를 알지 못하여 제1항에 따른 조치를 명할 수 없을 때에는 스스로 그 인공구조물 등을 제거하는 등 조치를 한 후 보관하여야 한다. 이 경우 닳아 없어지거나 파괴될 우려가 있거나 보관하는 것이 매우 곤란한 인공구조물 등은 매각하여 그 대금을 보관할 수 있다.
If the police station chief cannot issue an order under paragraph ① because the name and address of the owner, possessor, or manager of the artificial structure, etc., are unknown, the chief shall take measures such as removing the artificial structure, etc., themselves and keep it in storage. In this case, if the artificial structure, etc., is likely to be worn out or destroyed, or if it is extremely difficult to store, it may be sold, and the proceeds shall be kept in storage.
제2항에 따른 인공구조물 등의 보관 및 매각 등에 필요한 사항은 대통령령으로 정한다.
Matters necessary for the storage and sale, etc., of artificial structures, etc., under paragraph ② shall be determined by Presidential Decree.
