제85조의2 모바일운전면허증 발급 및 운전면허증의 확인 등

시ㆍ도경찰청장은 제85조, 제85조의3, 제86조, 제87조에 따라 운전면허증을 발급받으려는 사람이 모바일운전면허증(「전기통신사업법」 제2조제20호에 따른 이동통신단말장치에 암호화된 형태로 설치된 운전면허증을 말한다. 이하 같다)을 신청하는 경우 이를 추가로 발급할 수 있다. <개정 2025.1.21>
A Metropolitan Police Agency Commissioner may additionally issue a mobile driver's license (meaning a driver's license installed in an encrypted form on a mobile communication terminal device under Article 2, Section 20 of the 「Telecommunications Business Act」. The same applies hereinafter) to a person who intends to obtain a driver's license under Article 85, Article 85-3, Article 86, and Article 87, if such person applies for a mobile driver's license. <Amended on January 21, 2025>
국가기관, 지방자치단체, 공공단체, 사회단체, 기업체 등에서 다음 각 호의 경우에 운전면허소지자의 성명ㆍ사진ㆍ주소ㆍ주민등록번호ㆍ운전면허번호 등을 확인할 필요가 있으면 증빙서류를 붙이지 아니하고 운전면허증(제1항에 따른 모바일운전면허증을 포함한다. 이하 제87조의2ㆍ제92조ㆍ제93조ㆍ제95조제1항ㆍ제139조 및 제152조에서 같다)으로 확인하여야 한다. 다만, 다른 법률에서 신분의 확인 방법 등을 정한 경우에는 그러하지 아니하다.
1. 제80조제2항에 따른 운전면허의 범위 및 운전할 수 있는 차의 종류를 확인하는 경우
2. 민원서류나 그 밖의 서류를 접수하는 경우
3. 특정인에게 자격을 인정하는 증서를 발급하는 경우
4. 그 밖에 신분을 확인하기 위하여 필요한 경우
When a national agency, local government, public organization, social organization, enterprise, etc. needs to verify the name, photograph, address, resident registration number, driver's license number, etc. of a driver's license holder in the following cases, it shall verify it using the driver's license (including a mobile driver's license under Paragraph ①. The same applies hereinafter to Article 87-2, Article 92, Article 93, Article 95(1), Article 139, and Article 152), without attaching supporting documents. However, this shall not apply if the method of identity verification, etc. is stipulated in other laws. 1. 시ㆍ도경찰청장은 경찰청에 연계된 운전면허정보를 이용하여 운전면허확인서비스(이동통신단말장치를 이용하여 제2항 각 호 외의 부분 본문에 따른 성명ㆍ사진ㆍ주소ㆍ주민등록번호ㆍ운전면허번호 및 발급 관련사항을 확인할 수 있는 서비스를 말한다. 이하 같다)를 제공할 수 있다.
A Metropolitan Police Agency Commissioner may provide a driver's license verification service (meaning a service that allows verification of the name, photograph, address, resident registration number, driver's license number, and issuance-related matters under the main clause of each subparagraph of Paragraph ② using a mobile communication terminal device. The same applies hereinafter) by utilizing driver's license information linked to the National Police Agency.
운전면허확인서비스를 이용하여 성명ㆍ사진ㆍ주소ㆍ주민등록번호ㆍ운전면허번호 및 발급 관련사항을 확인하는 경우 제2항에 따라 운전면허증으로 성명ㆍ사진ㆍ주민등록번호ㆍ운전면허번호 및 발급 관련사항을 확인한 것으로 본다.

모바일운전면허증 및 운전면허확인서비스의 발급 및 신청 등에 필요한 사항은 행정안전부령으로 정한다.
Matters necessary for the issuance and application of mobile driver's licenses and driver's license verification services, etc. shall be determined by a Presidential Decree.
