제121조의14 입국경로에 설치된 보세판매장 등의 물품에 대한 간접세의 특례

「관세법」 제196조제1항제1호 단서에 따라 보세판매장에서 같은 조 제4항 단서에 따른 물품(이하 이 조에서 "물품"이라 한다)을 판매하는 경우에는 그 물품에 대한 부가가치세 및 주세(이하 이 조에서 "부가가치세등"이라 한다)를 면제(부가가치세의 경우에는 영세율을 적용하는 것을 말한다. 이하 이 조에서 같다)한다. <개정 2020.12.29>
For goods (hereinafter referred to as "goods" in this Article) sold in duty-free shops under the proviso to Article 196 (1) (1) of the 「Customs Act」, where such goods are those referred to in the proviso to Article 196 (4) of the same Act, the value-added tax and liquor tax (hereinafter referred to as "value-added tax, etc." in this Article) on such goods shall be exempted (in the case of value-added tax, it means applying a zero rate. 「관세법」 제196조제2항에 따른 보세판매장에서 우리나라로 입국하는 자에게 물품을 판매하는 경우에는 그 물품에 대한 부가가치세등을 면제한다. <신설 2020.12.29>
For goods sold to persons entering Korea in duty-free shops under Article 196 (2) of the 「Customs Act」, the value-added tax, etc. on such goods shall be exempted. <Newly Inserted by Act No. 17854, Dec. 29, 2020>
사업자가 「관세법」 제2조제5호에 따른 내국물품을 제1항 또는 제2항에 따른 보세판매장에 공급하는 경우에는 대통령령으로 정하는 바에 따라 부가가치세등을 면제한다. <개정 2020.12.29>
Where a business operator supplies domestic goods as defined in Article 2 (5) of the 「Customs Act」 to duty-free shops under paragraph (1) or (2), the value-added tax, etc. shall be exempted according to Presidential Decree. <Amended by Act No. 17854, Dec. 29, 2020>
물품에 대한 부가가치세등의 면제절차, 물품의 부정구입에 따른 감면세액의 징수에 관하여 필요한 사항은 대통령령으로 정한다. <개정 2020.12.29>
Necessary matters concerning the procedures for exemption of value-added tax, etc. on goods, and the collection of reduced or exempted taxes due to the illicit purchase of goods, shall be determined by Presidential Decree. <Amended by Act No. 17854, Dec. 29, 2020>
