Article 21-2 (Exemption from Income Tax on Interest Income from Time Foreign Currency Deposits of Non-residents, etc.)
제21조의2 비거주자등의 정기외화예금에 대한 이자소득세 비과세

비거주자 또는 외국법인(비거주자 또는 외국법인의 국내사업장은 제외한다. 이하 이 조에서 "비거주자등"이라 한다)이 계약기간 1년 이상인 대통령령으로 정하는 정기외화예금에 2015년 12월 31일까지 가입하는 경우 해당 예금에서 계약기간 내에 발생하는 이자에 대해서는 소득세 또는 법인세를 부과하지 아니한다.
Where a non-resident or foreign corporation (excluding a permanent establishment of a non-resident or foreign corporation; hereinafter referred to as "non-resident, etc." in this Article) subscribes to a time foreign currency deposit, prescribed by Presidential Decree, with a contract period of one year or more by December 31, 2015, income tax or corporate tax shall not be imposed on interest arising from such deposit within the contract period.
제1항에 따른 예금의 가입자가 계약기간 내에 계약을 해지하거나 예금의 전부 또는 일부를 인출하는 경우 해당 예금을 취급하는 제21조제1항제2호에 따른 외국환업무취급기관은 대통령령으로 정하는 바에 따라 부과되지 아니한 소득세 또는 법인세에 상당하는 세액을 추징하여 해지 또는 인출한 날이 속하는 달의 다음 달 10일까지 원천징수 관할 세무서장에게 납부하여야 한다. 이 경우 그 기한까지 납부하지 아니하거나 납부하여야 할 세액에 미달하게 납부한 경우에는 그 납부하지 아니한 세액 또는 미달하게 납부한 세액의 100분의 10에 해당하는 금액을 추가로 납부하여야 한다.
If a subscriber to a deposit referred to in paragraph ① cancels the contract or withdraws all or part of the deposit within the contract period, the foreign exchange handling institution, as referred to in Article 21 (1) 2. that handles such deposit shall collect taxes equivalent to the income tax or corporate tax that has not been imposed, as prescribed by Presidential Decree, and pay them to the head of the tax office having jurisdiction over withholding by the 10th of the month following the month in which the cancellation or withdrawal occurs. In this case, if the taxes are not paid by the due date or are paid in an amount less than the taxes payable, an additional amount equivalent to 100분의 10 of the unpaid taxes or the underpaid taxes shall be paid.
비거주자등의 정기외화예금 가입 시 제출서류, 예금 계약의 변경ㆍ갱신에 대한 적용방법 등 그 밖에 필요한 사항은 대통령령으로 정한다.
The documents to be submitted upon subscription to a time foreign currency deposit by a non-resident, etc., the method of application for changes and renewals of deposit contracts, and other necessary matters shall be prescribed by Presidential Decree.
