Article 17-2 (Designation of Waste Analysis Specialist Agency)
제17조의2 폐기물분석전문기관의 지정

기후에너지환경부장관은 폐기물에 관한 시험ㆍ분석 업무를 전문적으로 수행하기 위하여 다음 각 호의 기관을 폐기물 시험ㆍ분석 전문기관(이하 "폐기물분석전문기관"이라 한다)으로 지정할 수 있다. <개정 2025.10.1>
1. 「한국환경공단법」에 따른 한국환경공단(이하 "한국환경공단"이라 한다)
2. 「수도권매립지관리공사의 설립 및 운영 등에 관한 법률」에 따른 수도권매립지관리공사
3. 「보건환경연구원법」에 따른 보건환경연구원
4. 그 밖에 기후에너지환경부장관이 폐기물의 시험ㆍ분석 능력이 있다고 인정하는 기관
The Minister of Climate, Energy and Environment may designate institutions that specialize in the testing and analysis of waste as waste testing and analysis specialist agencies (hereinafter referred to as "waste analysis specialist agencies") among the following categories. <Amended on Oct. 1, 2025> 1. Korea Environment Corporation under the 「Act on the Korea Environment Corporation」 (hereinafter referred to as "Korea Environment Corporation") 2. Sudokwon Landfill Management Corporation under the 「Act on the Establishment and Operation of Sudokwon Landfill Management Corporation, etc.」 3. Health and Environment Research Institute under the 「Act on Health and Environment Research Institutes」 4. Other institutions recognized by the Minister of Climate, Energy and Environment as having waste testing and analysis capabilities
제1항제4호에 따른 기관이 폐기물분석전문기관으로 지정을 받으려는 경우에는 대통령령으로 정하는 시설, 장비 및 기술능력을 갖추어 기후에너지환경부장관에게 지정을 신청하여야 한다. <개정 2025.10.1>
An institution referred to in subparagraph 4 of paragraph ①, intending to be designated as a waste analysis specialist agency, shall apply for designation to the Minister of Climate, Energy and Environment after meeting the facilities, equipment, and technical capabilities prescribed by Presidential Decree. <Amended on Oct. 1, 2025>
제1항제4호에 따라 폐기물분석전문기관으로 지정받은 기관은 지정받은 사항 중 기후에너지환경부령으로 정하는 중요한 사항을 변경하려는 경우에는 기후에너지환경부장관으로부터 변경지정을 받아야 한다. <개정 2025.10.1>
If an institution designated as a waste analysis specialist agency under subparagraph 4 of paragraph ① intends to change important matters prescribed by the Minister of Climate, Energy and Environment among the designated matters, it shall obtain a revised designation from the Minister of Climate, Energy and Environment. <Amended on Oct. 1, 2025>
기후에너지환경부장관은 제1항 각 호의 기관을 폐기물분석전문기관으로 지정하거나 변경지정하였을 때에는 해당 기관에 지정서를 발급하고, 그 내용을 관보나 인터넷 홈페이지 등에 게시하는 방법으로 공고하여야 한다. <개정 2025.10.1>
When the Minister of Climate, Energy and Environment designates or revises the designation of institutions in subparagraphs of paragraph ① as waste analysis specialist agencies, the Minister shall issue a certificate of designation to the relevant institution and publicly announce the details by publishing them in the Official Gazette or on the internet homepage, etc. <Amended on Oct. 1, 2025>
제1항제4호에 따른 폐기물분석전문기관의 결격사유에 관하여는 제26조를 준용한다. 이 경우 "폐기물처리업"은 "폐기물분석전문기관"으로, "허가"는 "지정"으로, "제27조(제1항제2호 및 제2항제20호는 제외한다)"는 "제17조의5(제1항제2호 및 제2항제6호는 제외한다)"로 본다.
Regarding the disqualification grounds for waste analysis specialist agencies under subparagraph 4 of paragraph ①, Article 26 shall apply mutatis mutandis. In this case, "waste treatment business" shall be deemed "waste analysis specialist agency," "license" shall be deemed "designation," and "Article 27 (excluding Article 27(1)2 and 20(2))" shall be deemed "Article 17-5 (excluding Article 17-5(1)2 and 6(2))."
