제18조의2 유해성 정보자료의 작성ㆍ제공 의무

사업장폐기물배출자는 기후에너지환경부령으로 정하는 사업장폐기물을 배출하는 경우에는 기후에너지환경부령으로 정하는 바에 따라 스스로 또는 기후에너지환경부령으로 정하는 전문기관에 의뢰하여 다음 각 호의 사항을 포함한 유해성 정보자료(이하 "유해성 정보자료"라 한다)를 작성하여야 한다. <개정 2025.10.1>

2. 사업장폐기물의 물리ㆍ화학적 성질 및 취급 시 주의사항
3. 사업장폐기물로 인하여 화재 등의 사고 발생 시 방제 등 조치방법
4. 그 밖에 기후에너지환경부령으로 정하는 사항
A generator of industrial waste shall, when generating industrial waste as prescribed by the Minister of Climate, Energy and Environment, prepare hazardous information data (hereinafter referred to as "hazardous information data") including the matters specified in the following subparagraphs, by themselves or by requesting a specialized agency prescribed by the Minister of Climate, Energy and Environment, in accordance with the provisions of the Ordinance of the Minister of Climate, Energy and Environment: <Amended by Act No. 2025.10.1> 1. Types of industrial waste 2. Physical and chemical properties of industrial waste and precautions when handling them 3. Methods of response, such as disaster control, in case of accidents such as fires caused by industrial waste 4. Other matters prescribed by the Minister of Climate, Energy and Environment
사업장폐기물배출자는 제1항에 따라 유해성 정보자료를 작성한 후 생산공정이나 사용 원료의 변경 등 기후에너지환경부령으로 정하는 중요사항이 변경된 경우에는 기후에너지환경부령으로 정하는 바에 따라 그 변경내용을 반영하여 스스로 또는 기후에너지환경부령으로 정하는 기관에 의뢰하여 유해성 정보자료를 다시 작성하여야 한다. <개정 2025.10.1>
A generator of industrial waste shall, after preparing hazardous information data pursuant to paragraph ①, if important matters prescribed by the Minister of Climate, Energy and Environment, such as changes in the production process or raw materials used, are changed, re-prepare the hazardous information data by reflecting the changes by themselves or by requesting an agency prescribed by the Minister of Climate, Energy and Environment, in accordance with the provisions of the Ordinance of the Minister of Climate, Energy and Environment. <Amended by Act No. 2025.10.1>
사업장폐기물배출자는 해당 사업장폐기물을 제18조제1항에 따라 위탁하여 처리하는 경우에는 수탁자에게 제1항 및 제2항에 따라 작성한 유해성 정보자료를 제공하여야 한다.
A generator of industrial waste shall provide the hazardous information data prepared pursuant to paragraphs ① and ② to the consignee when entrusting the processing of such industrial waste pursuant to Article 18 (1).
사업장폐기물배출자와 수탁자는 제1항, 제2항 및 제3항에 따라 작성하거나 제공받은 유해성 정보자료를 사업장폐기물의 수집ㆍ운반차량, 보관장소 및 처리시설에 각각 게시하거나 비치하여야 한다.
A generator of industrial waste and a consignee shall post or keep the hazardous information data prepared or received pursuant to paragraphs ①, ②, and ③ at the collection and transportation vehicles, storage sites, and treatment facilities of industrial waste, respectively.
