Article 25-3 (Confirmation of Suitability for Waste Treatment Business)
제25조의3 폐기물처리업의 적합성확인

폐기물처리업자는 대통령령으로 정하는 업종별 적합성확인의 유효기간이 경과할 때마다 기후에너지환경부장관 또는 시ㆍ도지사로부터 다음 각 호의 사항을 모두 충족하여 폐기물처리업을 계속 수행할 수 있는 적합성을 갖추었음을 확인 받아야 한다. <개정 2025.10.1>
1. 제13조에 따른 폐기물의 처리 기준과 방법 또는 제13조의2에 따른 폐기물의 재활용 원칙 및 준수사항을 충족하는 등 기후에너지환경부령으로 정하는 조건을 갖추고 있을 것
2. 제26조에 따른 결격사유에 해당하지 아니할 것
3. 이 법을 위반하여 발생한 법적 책임을 모두 이행하였을 것
A waste treatment business operator shall, upon expiration of the validity period of suitability confirmation by type of business as prescribed by Presidential Decree, obtain confirmation from the Minister of Climate, Energy and Environment or the Mayor/Provincial Governor that the business operator is suitable to continue conducting the waste treatment business by satisfying all of the following matters: <Amended by Act No. X, Oct. 1, 2025> 1. Possessing the conditions prescribed by the Minister of Climate, Energy and Environment Ordinance, such as satisfying the waste treatment standards and methods under Article 13 or the principles and compliance matters for waste recycling under Article 13-2 2. Not falling under the grounds for disqualification under Article 26 3. Having fulfilled all legal liabilities arising from violations of this Act
제1항에 따라 적합성확인을 받으려는 자(이하 이 조에서 "적합성확인신청인"이라 한다)는 업종별 적합성확인 유효기간이 만료되기 3개월 전까지 기후에너지환경부령으로 정하는 바에 따라 제1항 각 호의 사항을 확인하는 데 필요한 자료를 첨부하여 기후에너지환경부장관 또는 시ㆍ도지사에게 신청하여야 한다. 이 경우 적합성확인신청을 받은 기후에너지환경부장관 또는 시ㆍ도지사는 특별한 사정이 없으면 유효기간 만료일 이전에 적합성 여부를 확인하여 적합성확인신청인에게 통보하여야 한다. <개정 2025.10.1>
An applicant for suitability confirmation under paragraph (1) (hereinafter referred to as the "suitability confirmation applicant" in this Article) shall apply to the Minister of Climate, Energy and Environment or the Mayor/Provincial Governor, attaching the materials necessary for confirming the matters listed in each subparagraph of paragraph (1), in accordance with the Minister of Climate, Energy and Environment Ordinance, no later than three months before the expiration of the validity period of suitability confirmation by type of business. In this case, the Minister of Climate, Energy and Environment or the Mayor/Provincial Governor who has received the suitability confirmation application shall, in the absence of special circumstances, confirm suitability before the expiration date and notify the suitability confirmation applicant. <Amended by Act No. X, Oct. 1, 2025>
제2항 후단에도 불구하고 기후에너지환경부장관 또는 시ㆍ도지사가 적합성확인기간 만료일까지 적합성 여부를 확인하여 적합성확인신청인에게 통보하지 아니한 경우에는 적합성확인신청인은 적합성확인 유효기간이 만료된 이후에도 폐기물처리업을 계속 영위할 수 있다. <개정 2025.10.1>
Notwithstanding the latter part of paragraph (2), if the Minister of Climate, Energy and Environment or the Mayor/Provincial Governor has not confirmed suitability and notified the suitability confirmation applicant by the expiration date of the suitability confirmation period, the suitability confirmation applicant may continue to operate the waste treatment business after the expiration of the validity period of suitability confirmation. <Amended by Act No. X, Oct. 1, 2025>
기후에너지환경부장관 또는 시ㆍ도지사가 적합성확인신청인에게 적합성확인을 한 때에는 그 적합성확인 유효기간은 종전의 유효기간이 만료된 날의 다음날부터 기산하는 것으로 한다. <개정 2025.10.1>
When the Minister of Climate, Energy and Environment or the Mayor/Provincial Governor has confirmed suitability for a suitability confirmation applicant, the validity period of the suitability confirmation shall be calculated from the day following the expiration date of the previous validity period. <Amended by Act No. X, Oct. 1, 2025>
기후에너지환경부장관 또는 시ㆍ도지사는 적합성확인을 위하여 필요한 경우 적합성확인신청인에게 추가 자료를 제출하거나 필요한 조치를 취할 것을 요구할 수 있다. <개정 2025.10.1>
The Minister of Climate, Energy and Environment or the Mayor/Provincial Governor may, if necessary for suitability confirmation, request the suitability confirmation applicant to submit additional materials or take necessary measures. <Amended by Act No. X, Oct. 1, 2025>
기후에너지환경부장관 또는 시ㆍ도지사는 다음 각 호의 어느 하나에 해당하는 경우에는 해당 적합성확인신청인에 대하여 적합성확인을 하지 아니할 수 있다. <개정 2025.10.1>
1. 적합성확인 유효기간이 만료될 때까지 적합성확인신청인으로부터 적합성확인신청서 또는 적합성확인을 위하여 필요한 자료를 제출받지 못한 경우
2. 적합성확인신청인이 제1항 각 호의 요건을 갖추지 못한 경우
The Minister of Climate, Energy and Environment or the Mayor/Provincial Governor may refuse to confirm suitability for a suitability confirmation applicant if any of the following applies: <Amended by Act No. X, Oct. 1, 2025> 1. The suitability confirmation application or materials necessary for suitability confirmation have not been submitted by the suitability confirmation applicant by the expiration date of the validity period of suitability confirmation. 2. The suitability confirmation applicant does not meet the requirements of each subparagraph of paragraph (1).
그 밖에 적합성확인신청 절차 등에 필요한 사항은 기후에너지환경부령으로 정한다. <개정 2025.10.1>
