Article 29 (Installation of Waste Treatment Facilities)
제29조 폐기물처리시설의 설치

폐기물처리시설은 기후에너지환경부령으로 정하는 기준에 맞게 설치하되, 기후에너지환경부령으로 정하는 규모 미만의 폐기물 소각 시설을 설치ㆍ운영하여서는 아니 된다. <개정 2025.10.1>
Waste treatment facilities shall be installed in accordance with the standards prescribed by the Minister of Climate, Energy and Environment, and no waste incineration facilities smaller than the scale prescribed by the Minister of Climate, Energy and Environment shall be installed or operated. <Amended on October 1, 2025>
제25조제3항에 따른 폐기물처리업의 허가를 받았거나 받으려는 자 외의 자가 폐기물처리시설을 설치하려면 기후에너지환경부장관의 승인을 받아야 한다. 다만, 제1호의 폐기물처리시설을 설치하는 경우는 제외하며, 제2호의 폐기물처리시설을 설치하려면 기후에너지환경부장관에게 신고하여야 한다. <개정 2025.10.1>
1. 학교ㆍ연구기관 등 기후에너지환경부령으로 정하는 자가 기후에너지환경부령으로 정하는 바에 따라 시험ㆍ연구목적으로 설치ㆍ 운영하는 폐기물처리시설
2. 기후에너지환경부령으로 정하는 규모의 폐기물처리시설
Any person other than a person who has obtained or intends to obtain a license for a waste treatment business under Article 25 (3) shall obtain approval from the Minister of Climate, Energy and Environment to install a waste treatment facility. However, this shall not apply to the installation of waste treatment facilities referred to in subparagraph 1, and the installation of waste treatment facilities referred to in subparagraph 2 shall be reported to the Minister of Climate, Energy and Environment. <Amended on October 1, 2025> 1. Waste treatment facilities installed and operated for testing and research purposes by persons prescribed by the Minister of Climate, Energy and Environment, such as schools and research institutions, in accordance with the methods prescribed by the Minister of Climate, Energy and Environment. 2. Waste treatment facilities of a scale prescribed by the Minister of Climate, Energy and Environment.
제2항의 경우에 승인을 받았거나 신고한 사항 중 기후에너지환경부령으로 정하는 중요사항을 변경하려면 각각 변경승인을 받거나 변경신고를 하여야 한다. <개정 2025.10.1>
In cases falling under paragraph (2), if any important matters prescribed by the Minister of Climate, Energy and Environment among the approved or reported matters are to be changed, change approval or change notification shall be obtained or made, respectively. <Amended on October 1, 2025>
폐기물처리시설을 설치하는 자는 그 설치공사를 끝낸 후 그 시설의 사용을 시작하려면 다음 각 호의 구분에 따라 해당 행정기관의 장에게 신고하여야 한다.
1. 폐기물처리업자가 설치한 폐기물처리시설의 경우 : 제25조제3항에 따른 허가관청
2. 제1호 외의 폐기물처리시설의 경우 : 제29조제2항에 따른 승인관청 또는 신고관청
A person who installs a waste treatment facility shall, after completing the installation work and before commencing the use of the facility, report to the head of the competent administrative agency in accordance with the following classifications: 1. In the case of waste treatment facilities installed by a waste treatment business operator: The licensing authority under Article 25 (3). 2. In the case of waste treatment facilities other than those referred to in subparagraph 1: The approving authority or reporting authority under Article 29 (2).
기후에너지환경부장관 또는 해당 행정기관의 장은 제2항, 제3항 또는 제4항에 따른 신고ㆍ변경신고를 받은 날부터 20일 이내에 신고ㆍ변경신고수리 여부를 신고인에게 통지하여야 한다. <신설 2017.4.18, 2025.10.1>
The Minister of Climate, Energy and Environment or the head of the competent administrative agency shall notify the reporter of whether the report or change notification has been accepted within 20 days from the date of receipt of the report or change notification under paragraph (2) or (3) or (4). <Newly inserted on April 18, 2017, Amended on October 1, 2025>
기후에너지환경부장관 또는 해당 행정기관의 장이 제5항에서 정한 기간 내에 신고ㆍ변경신고수리 여부나 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간이 끝난 날의 다음 날에 신고ㆍ변경신고를 수리한 것으로 본다. <신설 2017.4.18, 2025.10.1>
If the Minister of Climate, Energy and Environment or the head of the competent administrative agency does not notify the reporter of the acceptance of the report or change notification or the extension of the processing period under the laws and regulations concerning civil complaint processing within the period prescribed in paragraph (5), the report or change notification shall be deemed to have been accepted on the day following the expiration of the period. <Newly inserted on April 18, 2017, Amended on October 1, 2025>
