이 법은 다음 각 호의 어느 하나에 해당하는 물질에 대하여는 적용하지 아니한다. <개정 2007.5.17, 2007.12.21, 2010.7.23, 2011.7.21, 2011.7.25, 2015.1.20, 2017.1.17, 2022.4.26>
1. 「원자력안전법」에 따른 방사성 물질과 이로 인하여 오염된 물질
2. 용기에 들어 있지 아니한 기체상태의 물질
3. 「물환경보전법」에 따른 수질 오염 방지시설에 유입되거나 공공 수역(水域)으로 배출되는 폐수
4. 「가축분뇨의 관리 및 이용에 관한 법률」에 따른 가축분뇨
5. 「하수도법」에 따른 하수ㆍ분뇨
6. 「가축전염병예방법」 제22조제2항, 제23조, 제33조 및 제44조가 적용되는 가축의 사체, 오염 물건, 수입 금지 물건 및 검역 불합격품
7. 「수산생물질병 관리법」 제17조제2항, 제18조, 제25조제1항 각 호 및 제34조제1항이 적용되는 수산동물의 사체, 오염된 시설 또는 물건, 수입금지물건 및 검역 불합격품
8. 「군수품관리법」 제13조의2에 따라 폐기되는 탄약
9. 「동물보호법」 제69조제1항에 따른 동물장묘업의 허가를 받은 자가 설치ㆍ운영하는 동물장묘시설에서 처리되는 동물의 사체
This Act shall not apply to substances falling under any of the following subparagraphs. <Amended by Act No. 8449, May 17, 2007; Act No. 8748, Dec. 21, 2007; Act No. 10381, Jul. 23, 2010; Act No. 10833, Jul. 21, 2011; Act No. 10842, Jul. 25, 2011; Act No. 13075, Jan. 20, 2015; Act No. 14517, Jan. 17, 2017; Act No. 18541, Apr. 26, 2022> 1. Radioactive materials and materials contaminated therewith, pursuant to the 「Act on the Safety Management of Nuclear Energy」 2. Gaseous substances not contained in containers 3. Wastewater that flows into wastewater treatment facilities pursuant to the 「Water Environment Conservation Act」 or is discharged into public waters 4. Livestock manure pursuant to the 「Act on the Management and Utilization of Livestock Manure」 5. Sewage and night soil pursuant to the 「Sewerage Act」 6. Carcasses of livestock, contaminated articles, prohibited imported goods, and goods failing inspection, to which Articles 22 (2), 23, 33, and 44 of the 「Act on Prevention of Contagious Diseases Among Livestock」 apply 7. Carcasses of aquatic animals, contaminated facilities or articles, prohibited imported goods, and goods failing inspection, to which Articles 17 (2), 18, 25 (1) (each subparagraph), and 34 (1) of the 「Act on the Control of Aquatic Animal Diseases」 apply 8. Ammunition to be disposed of pursuant to Article 13-2 of the 「Military Supplies Management Act」 9. Carcasses of animals processed at animal crematoria facilities established and operated by a person permitted for the business of animal crematoria pursuant to Article 69 (1) of the 「Animal Protection Act」
이 법에 따른 폐기물의 해역 배출은 「해양폐기물 및 해양오염퇴적물 관리법」으로 정하는 바에 따른다. <개정 2019.12.3>
The discharge of waste into marine areas under this Act shall be governed by the 「Act on the Management of Marine Waste and Marine Pollution Sediments」. <Amended by Act No. 16855, Dec. 3, 2019>
「수산부산물 재활용 촉진에 관한 법률」에 따른 수산부산물이 다른 폐기물과 혼합된 경우에는 이 법을 적용하고, 다른 폐기물과 혼합되지 않아 수산부산물만 배출ㆍ수집ㆍ운반ㆍ재활용하는 경우에는 이 법을 적용하지 아니한다. <신설 2021.7.20>
If fishery byproducts pursuant to the 「Act on the Promotion of Recycling of Fishery Byproducts」 are mixed with other waste, this Act shall apply; if only fishery byproducts are discharged, collected, transported, or recycled without being mixed with other waste, this Act shall not apply. <Newly inserted by Act No. 17919, Jul. 20, 2021>
