제30조 폐기물처리시설의 검사

기후에너지환경부령으로 정하는 폐기물처리시설의 설치를 마친 자는 제30조의2제3항에 따른 폐기물처리시설 검사기관으로부터 검사를 받아야 한다. 제29조제3항에 따른 변경승인을 받거나 변경신고를 한 경우로서 기후에너지환경부령으로 정하는 경우에도 또한 같다. <개정 2019.11.26, 2025.10.1>
A person who has completed the installation of a waste treatment facility as prescribed by a Decree of the Minister of Environment, Energy and Climate shall undergo an inspection by a waste treatment facility inspection agency under Article 30-2 (3). The same shall apply in cases where approval for alteration or notification of alteration under Article 29 (3) has been received and as prescribed by a Decree of the Minister of Environment, Energy and Climate. <Amended by Act No. ..., Nov. 26, 2019; Act No. ..., Oct. 1, 2025>
제1항에 따른 폐기물처리시설을 설치ㆍ운영하는 자는 기후에너지환경부령으로 정하는 기간마다 제1항에 따른 검사기관으로부터 정기검사를 받아야 한다. 이 경우 검사기간 내에 「환경기술 및 환경산업 지원법」 제13조에 따라 같은 시설에 대한 기술진단을 받으면 정기 검사를 받은 것으로 본다(「환경기술 및 환경산업 지원법」 제13조제3항에 따른 요청을 이행하지 아니한 경우는 제외한다). <개정 2011.4.28, 2012.6.1, 2025.10.1>
A person who installs or operates a waste treatment facility under paragraph (1) shall undergo a regular inspection by the inspection agency under paragraph (1) at intervals prescribed by a Decree of the Minister of Environment, Energy and Climate. In this case, if a technical diagnosis for the same facility has been received within the inspection period pursuant to Article 13 of the Act on Support for Environmental Technology and Environmental Industry, it shall be deemed that a regular inspection has been received (excluding cases where a request under Article 13 (3) of the Act on Support for Environmental Technology and Environmental Industry is not fulfilled). <Amended by Act No. ..., Apr. 28, 2011; Act No. ..., Jun. 1, 2012; Act No. ..., Oct. 1, 2025>
제1항 또는 제2항에 따른 검사에서 적합 판정을 받지 아니한 폐기물처리시설은 사용할 수 없다. 다만, 검사를 위하여 그 시설을 사용하는 경우에는 그러하지 아니하다.
A waste treatment facility that has not received a conformity judgment in an inspection under paragraph (1) or (2) shall not be used. However, this shall not apply to the use of the facility for the purpose of inspection.
