제32조 다른 법령에 따른 허가ㆍ신고 등의 의제

폐기물처리시설을 설치하려는 자가 제29조제2항에 따른 승인을 받거나 신고를 한 경우, 같은 항 제1호에 따른 폐기물처리시설을 설치하는 경우 및 제25조제3항에 따른 폐기물처리업의 허가를 받은 경우 그 폐기물처리시설과 관련한 다음 각 호의 허가ㆍ신고에 관하여 기후에너지환경부장관 또는 시ㆍ도지사가 관계 행정기관의 장과 미리 협의한 사항에 대해서는 해당 허가를 받거나 신고를 한 것으로 본다. <개정 2007.5.17, 2009.6.9, 2010.7.23, 2017.1.17, 2024.1.30, 2025.10.1>
1. 「대기환경보전법」 제23조제1항 및 제2항에 따른 배출시설의 설치허가 또는 신고

Where a person who intends to install a waste treatment facility receives approval or submits a notification under Article 29 (2), installs a waste treatment facility under Article 29 (2) 1., or obtains a permit for a waste treatment business under Article 25 (3), the relevant permits and notifications concerning such waste treatment facility shall be presumed to have been obtained or submitted, with respect to matters for which the Minister of Climate, Energy, Environment, or a metropolitan city mayor/provincial governor has consulted in advance with the head of the relevant administrative agency. <Amended by Act No. 7964, May 17, 2007; Act No. 9760, June 9, 2009; Act No. 10371, July 23, 2010; Act No. 14527, Jan. 17, 2017; Act No. 19948, Jan. 30, 2024; Act No. 21068, Oct. 1, 2025> 1. 음식물류 폐기물과 가축분뇨를 함께 처리하기 위한 기후에너지환경부령으로 정하는 폐기물처리시설을 설치하려는 자가 제25조제3항에 따른 폐기물처리업의 허가를 받은 경우 및 제29조제2항에 따른 승인을 받거나 신고를 한 경우, 같은 항 제1호에 따른 폐기물처리시설을 설치하는 경우 그 폐기물처리시설과 관련한 다음 각 호의 승인 또는 허가에 관하여 기후에너지환경부장관 또는 시ㆍ도지사가 관계 행정기관의 장과 미리 협의한 사항에 대해서는 해당 승인 또는 허가를 받은 것으로 본다. <신설 2012.6.1, 2024.1.30, 2025.10.1>

Where a person who intends to install a waste treatment facility for simultaneously treating food wastes and livestock manure, as prescribed by the Presidential Decree of the Minister of Climate, Energy, Environment, receives a permit for a waste treatment business under Article 25 (3), receives approval or submits a notification under Article 29 (2), or installs a waste treatment facility under Article 29 (2) 1., the relevant approvals or permits concerning such waste treatment facility shall be presumed to have been obtained, with respect to matters for which the Minister of Climate, Energy, Environment, or a metropolitan city mayor/provincial governor has consulted in advance with the head of the relevant administrative agency. <Newly Inserted by Act No. 11407, June 1, 2012; Act No. 19948, Jan. 30, 2024; Act No. 21068, Oct. 1, 2025> 1. 기후에너지환경부장관이나 시ㆍ도지사는 제1항부터 제3항까지의 규정 각 호의 어느 하나에 해당하는 사항이 포함되어 있는 폐기물처리시설의 설치승인을 하거나 신고를 받거나 폐기물처리업의 허가를 하려면 관계 행정기관의 장과 협의하여야 한다. <개정 2012.6.1, 2025.10.1>
Where the Minister of Climate, Energy, Environment, or a metropolitan city mayor/provincial governor intends to grant approval for the installation of a waste treatment facility or receive a notification or grant a permit for a waste treatment business, which includes any matter falling under any subparagraph of paragraphs (1) through (3), they shall consult with the head of the relevant administrative agency. <Amended by Act No. 11407, June 1, 2012; Act No. 21068, Oct. 1, 2025>
제1항부터 제4항까지에서 규정한 사항 외에 이 조에 따른 의제의 기준ㆍ효과 및 처리기준ㆍ절차의 통합 고시 등에 관하여는 「행정기본법」 제24조부터 제26조까지 및 「행정절차법」 제20조제2항을 준용한다. 이 경우 「행정절차법」 제20조제2항 중 "처분기준"은 "처리기준ㆍ절차"로, "공표"는 "고시"로 본다. <개정 2024.1.30>
Matters not provided for in paragraphs (1) through (4) regarding the standards and effects of presumption under this Article, and integrated notification of treatment standards and procedures, etc., shall be governed by Article 24 through Article 26 of the 「Administrative Basic Act」 and Article 20 (2) of the 「Administrative Procedure Act」.
