제36조 장부 등의 기록과 보존

다음 각 호의 어느 하나에 해당하는 자는 기후에너지환경부령으로 정하는 바에 따라 장부를 갖추어 두고 폐기물의 발생ㆍ배출ㆍ처리상황 등(제1호의2에 해당하는 자의 경우에는 폐기물의 발생량ㆍ재활용상황ㆍ처리실적 등을, 제4호의2에 해당하는 자의 경우에는 전용용기의 생산ㆍ판매량ㆍ품질검사 실적 등을, 제7호에 해당하는 자의 경우에는 제품과 용기 등의 생산ㆍ수입ㆍ판매량과 회수ㆍ처리량 등을 말한다)을 기록하고, 마지막으로 기록한 날부터 3년(제1호의 경우에는 2년)간 보존하여야 한다. 다만, 제45조제2항에 따른 전자정보처리프로그램을 이용하는 경우에는 그러하지 아니하다. <개정 2007.8.3, 2010.7.23, 2013.7.16, 2015.1.20, 2017.4.18, 2025.10.1>

A person falling under any of the following subparagraphs shall keep books and record the status of waste generation, discharge, and treatment, etc. (in the case of a person falling under subparagraph 1-2, the amount of waste generated, recycling status, and treatment performance, etc.; in the case of a person falling under subparagraph 4-2, the production and sales volume of dedicated containers, quality inspection performance, etc.; and in the case of a person falling under subparagraph 7, the production, import, and sales volume of products and containers, etc., and the recovery and treatment volume, etc.), as prescribed by the Ordinance of the Ministry of Climate, Energy and Environment, and preserve them for 3 years (2 years in the case of subparagraph 1) from the last date of recording. 제1항에도 불구하고 제25조제5항제2호부터 제7호까지에 따른 영업을 하는 자 또는 제46조제1항제1호에 해당하는 자는 제1항에 따라 장부에 기록하고 보존하여야 하는 폐기물의 발생ㆍ배출ㆍ처리상황 등(이하 "장부기록사항"이라 한다)을 기후에너지환경부령으로 정하는 바에 따라 제45조제2항에 따른 전자정보처리프로그램에 입력하여야 한다. <신설 2017.11.28, 2019.11.26, 2025.10.1>
