제5조의3 반입협력금의 징수

기후에너지환경부령으로 정하는 생활폐기물을 제5조의2제2항에 따라 반입하여 처리한 특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장은 해당 생활폐기물을 반출한 특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장으로부터 해당 생활폐기물의 반입량을 고려하여 산정한 금액(이하 "반입협력금"이라 한다)을 징수할 수 있다. 이 경우 「폐기물처리시설 설치촉진 및 주변지역지원 등에 관한 법률」 제8조에 따른 가산금은 징수한 것으로 본다. <개정 2025.10.1>
The Special Mayor, Special Governor, Mayor, County Governor, or District Head who has processed general waste delivered under Article 5-2, Paragraph 2, as prescribed by the Ordinance of the Ministry of Climate, Energy, and Environment, may collect an amount calculated considering the volume of general waste delivered (hereinafter referred to as the "Inbound Cooperation Fee") from the Special Mayor, Special Governor, Mayor, County Governor, or District Head who has transported out the said general waste. In this case, the additional charge under Article 8 of the "Act on Promotion of Installation of Waste Treatment Facilities and Support for Surrounding Areas" shall be deemed to have been collected. <Amended on October 1, 2025>
반입협력금은 기후에너지환경부령으로 정하는 범위에서 제1항에 따라 생활폐기물을 반입하여 처리하는 지방자치단체의 조례로 정한다. <개정 2025.10.1>
The Inbound Cooperation Fee shall be determined by the ordinance of the local government that processes general waste delivered under Paragraph 1, within the scope prescribed by the Ordinance of the Ministry of Climate, Energy, and Environment. <Amended on October 1, 2025>
반입협력금은 다음 각 호의 용도로 사용하여야 한다. <개정 2025.10.1>
1. 폐기물처리시설 주변 지역의 환경개선과 주민 지원
2. 폐기물처리시설의 설치ㆍ운영 및 개선
3. 폐기물의 발생 억제 및 적정 처리 방법에 관한 연구ㆍ개발
4. 그 밖에 폐기물의 발생 억제 및 적정 처리를 위하여 기후에너지환경부령으로 정하는 사업
The Inbound Cooperation Fee shall be used for the following purposes: <Amended on October 1, 2025> 1. Environmental improvement and resident support for areas surrounding waste treatment facilities 2. Installation, operation, and improvement of waste treatment facilities 3. Research and development on waste generation reduction and appropriate treatment methods 4. Other projects prescribed by the Ordinance of the Ministry of Climate, Energy, and Environment for waste generation reduction and appropriate treatment
