Article 52 (Advance Deposit of Post-Closure Management Guarantee Deposit)

The Minister of Climate, Energy, and Environment may require any person who installs a facility for the disposal of waste, as prescribed by Presidential Decree, to deposit in advance, in accordance with Presidential Decree, the entire amount of expenses for post-closure management into the Special Account for Environmental Improvement under the 「Framework Act on Environmental Policy」 before the amount of waste landfilled exceeds 50 percent of the disposal capacity permitted or changed under Article 25 (3) and (11) or approved or changed under Article 29 (2) and (3). Provided, however, that if the person falls under any of the following subparagraphs, the advance deposit of the post-closure management guarantee deposit may be replaced: 1. If insured under a guarantee insurance policy for post-closure management, etc. 2. If collateral equivalent to all or part of the expenses for post-closure management, etc. (excluding waste landfill facilities) is provided.
