제8조 폐기물의 투기 금지 등

누구든지 특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장이나 공원ㆍ도로 등 시설의 관리자가 폐기물의 수집을 위하여 마련한 장소나 설비 외의 장소에 폐기물을 버리거나, 특별자치시, 특별자치도, 시ㆍ군ㆍ구의 조례로 정하는 방법 또는 공원ㆍ도로 등 시설의 관리자가 지정한 방법을 따르지 아니하고 생활폐기물을 버려서는 아니 된다. <개정 2007.8.3, 2013.7.16, 2021.1.5>
No person shall dump waste in a place other than a place or facility prepared for waste collection by the special self-governing mayor, the governor of a special self-governing province, or the mayor, county governor, or head of a district, or by the manager of a facility such as a park or road, nor shall any person dump general waste in violation of the methods prescribed by the ordinances of the special self-governing city, special self-governing province, city, county, or district, or the methods designated by the manager of a facility such as a park or road. <Amended by Act No. 8579, Aug. 3, 2007, Act No. 11974, Jul. 16, 2013, Act No. 17897, Jan. 5, 2021>
누구든지 이 법에 따라 허가 또는 승인을 받거나 신고한 폐기물처리시설이 아닌 곳에서 폐기물을 매립하거나 소각하여서는 아니 된다. 다만, 제14조제1항 단서에 따른 지역에서 해당 특별자치시, 특별자치도, 시ㆍ군ㆍ구의 조례로 정하는 바에 따라 소각하는 경우에는 그러하지 아니하다. <개정 2007.8.3, 2013.7.16>
No person shall bury or incinerate waste in a place other than a waste treatment facility permitted or approved, or reported, under this Act. Provided, however, that this shall not apply to incineration conducted in accordance with the ordinances of the relevant special self-governing city, special self-governing province, city, county, or district in an area falling under the proviso to Article 14 (1). <Amended by Act No. 8579, Aug. 3, 2007, Act No. 11974, Jul. 16, 2013>

The special self-governing mayor, the governor of a special self-governing province, or the mayor, county governor, or head of a district may order the owner, possessor, or manager of land or a building to take necessary measures in accordance with the ordinances of the relevant local government if they fail to maintain cleanliness pursuant to Article 7 (2). <Amended by Act No. 8579, Aug. 3, 2007, Act No. 11974, Jul. 16, 2013>
