Article 13 (Effectuation Time of Payment)
제13조 지급의 효력발생시기

전자지급수단을 이용하여 자금을 지급하는 경우에는 그 지급의 효력은 다음 각 호의 어느 하나에서 정한 때에 생긴다. <개정 2013.5.22, 2014.10.15>
1. 전자자금이체의 경우 : 거래지시된 금액의 정보에 대하여 수취인의 계좌가 개설되어 있는 금융회사 또는 전자금융업자의 계좌의 원장에 입금기록이 끝난 때
2. 전자적 장치로부터 직접 현금을 출금하는 경우 : 수취인이 현금을 수령한 때
3. 선불전자지급수단 및 전자화폐로 지급하는 경우 : 거래지시된 금액의 정보가 수취인이 지정한 전자적 장치에 도달한 때
4. 그 밖의 전자지급수단으로 지급하는 경우 : 거래지시된 금액의 정보가 수취인의 계좌가 개설되어 있는 금융회사 또는 전자금융업자의 전자적 장치에 입력이 끝난 때
When making a payment using an electronic payment instrument, the effectuation of the payment shall arise at the time specified in any of the following subparagraphs. <Amended on May 22, 2013, Oct. 15, 2014> 1. In the case of electronic fund transfer: When the deposit record is completed in the ledger of the financial institution or electronic financial business operator where the recipient's account is opened, with respect to the information of the amount of the transaction instructed. 2. In the case of withdrawing cash directly from an electronic device: When the recipient receives the cash. 3. In the case of payment with prepaid electronic payment instruments and electronic currency: When the information of the amount of the transaction instructed reaches the electronic device designated by the recipient. 4. In the case of payment with other electronic payment instruments: When the input of the information of the amount of the transaction instructed is completed in the electronic device of the financial institution or electronic financial business operator where the recipient's account is opened.
총자산 등을 감안하여 대통령령으로 정하는 금융회사 또는 전자금융업자는 이용자가 원하는 경우 대통령령으로 정하는 절차와 방법에 따라 이용자가 거래지시를 하는 때부터 일정 시간이 경과한 후에 전자자금이체의 지급 효력이 발생하도록 하여야 한다. <신설 2014.10.15>
A financial institution or electronic financial business operator designated by Presidential Decree, taking into account its total assets, etc., shall, upon the user's request, allow the payment of electronic fund transfers to take effect after a certain period has elapsed from the time the user makes a transaction instruction, according to the procedures and methods prescribed by Presidential Decree. <Newly Established on Oct. 15, 2014>
