제24조 약관의 명시와 변경통지 등

금융회사 또는 전자금융업자는 이용자와 전자금융거래의 계약을 체결함에 있어서 약관을 명시하여야 하고, 이용자의 요청이 있는 경우에는 금융위원회가 정하는 방법에 따라 그 약관의 사본을 교부하고 그 약관의 내용을 설명하여야 한다. <개정 2008.2.29, 2013.5.22>
A financial company or an electronic financial business operator shall disclose the terms and conditions when entering into a contract for electronic financial transactions with a user, and upon the user's request, shall provide a copy of the terms and conditions and explain the contents of the terms and conditions in the manner prescribed by the Financial Services Commission. <Amended by Act No. 9464, Feb. 29, 2008; Act No. 11773, May 22, 2013>
금융회사 또는 전자금융업자는 제1항의 규정을 위반하여 계약을 체결한 때에는 당해 약관의 내용을 계약의 내용으로 주장할 수 없다. <개정 2013.5.22>
If a financial company or an electronic financial business operator enters into a contract in violation of the provisions of paragraph ①, it shall not assert the contents of the terms and conditions as part of the contract. <Amended by Act No. 11773, May 22, 2013>
금융회사 또는 전자금융업자는 약관을 변경하는 때에는 변경되는 약관의 시행일 1월 전에 금융위원회가 정하는 방법에 따라 이를 게시하고 이용자에게 알려야 한다. 다만, 법령의 개정으로 인하여 긴급하게 약관을 변경하는 때에는 금융위원회가 정하는 방법에 따라 이를 즉시 게시하고 이용자에게 알려야 한다. <개정 2008.2.29, 2013.5.22>
When a financial company or an electronic financial business operator changes the terms and conditions, it shall post the changed terms and conditions and notify the user in the manner prescribed by the Financial Services Commission one month before the effective date of the changed terms and conditions. However, when the terms and conditions are urgently changed due to an amendment of laws and decrees, they shall be immediately posted and notified to the user in the manner prescribed by the Financial Services Commission. <Amended by Act No. 9464, Feb. 29, 2008; Act No. 11773, May 22, 2013>
이용자는 제3항의 규정에 따른 약관의 변경내용이 게시되거나 통지된 후부터 변경되는 약관의 시행일 전의 영업일까지 전자금융거래의 계약을 해지할 수 있다. 전단의 기간 안에 이용자가 약관의 변경내용에 대하여 이의를 제기하지 아니하는 경우에는 약관의 변경을 승인한 것으로 본다.
A user may terminate the contract for electronic financial transactions from the date when the details of the change of terms and conditions are posted or notified pursuant to paragraph ③ until the business day before the effective date of the changed terms and conditions. If a user does not raise an objection to the details of the change of terms and conditions within the period prescribed in the preceding sentence, it shall be deemed that the user has approved the change of terms and conditions.
