제27조의2 벌칙

다음 각 호의 어느 하나에 해당하는 자는 3년 이하의 징역 또는 3억원 이하의 벌금에 처한다. 다만, 위반행위의 목적물 가액의 3배가 3억원을 초과하는 경우에는 그 벌금을 목적물 가액의 3배 이하로 한다.
1. 제8조제1항 본문 또는 같은 조 제3항에 따른 등록을 하지 아니하거나, 거짓이나 그 밖의 부정한 방법으로 등록을 하고 외국환업무를 한 자(제8조제4항에 따른 폐지신고를 거짓으로 하고 외국환업무를 한 자 및 제12조제1항에 따른 처분을 위반하여 외국환업무를 한 자를 포함한다)
2. 제9조제1항 전단, 같은 조 제3항 또는 제5항에 따른 인가를 받지 아니하거나, 거짓이나 그 밖의 부정한 방법으로 인가를 받고 외국환중개업무를 한 자(제9조제3항에 따른 신고를 거짓으로 하고 외국환중개업무를 한 자 및 제12조제1항에 따른 처분을 위반하여 외국환중개업무를 한 자를 포함한다)
3. 제15조제2항에 따른 허가를 받지 아니하거나, 거짓이나 그 밖의 부정한 방법으로 허가를 받고 지급 또는 수령을 한 자
A person who falls under any of the following subparagraphs shall be punished by imprisonment for not more than 3 years or a fine of not more than 300 million won. However, if the value of the object of the violation exceeds 300 million won, the fine shall be not more than three times the value of the object. 1. A person who conducts foreign exchange business without registration under the main clause of Article 8 (1) or paragraph (3) of the same Article, or who obtains registration by false or other fraudulent means (including a person who conducts foreign exchange business after falsely reporting cessation under Article 8 (4) and a person who conducts foreign exchange business in violation of a disposition under Article 12 (1)). 2. A person who conducts foreign exchange brokerage business without permission under the first part of Article 9 (1), paragraph (3), or (5) of the same Article, or who obtains permission by false or other fraudulent means (including a person who conducts foreign exchange brokerage business after falsely reporting under Article 9 (3) and a person who conducts foreign exchange brokerage business in violation of a disposition under Article 12 (1)). 3. A person who makes payments or receives payments without permission under Article 15 (2), or who makes payments or receives payments after obtaining permission by false or other fraudulent means.
제1항의 징역과 벌금은 병과할 수 있다.
The imprisonment and fine under paragraph (1) may be imposed concurrently.
