외국인근로자를 고용한 사업 또는 사업장의 사용자(이하 "사용자"라 한다)는 외국인근로자의 출국 등에 따른 퇴직금 지급을 위하여 외국인근로자를 피보험자 또는 수익자(이하 "피보험자등"이라 한다)로 하는 보험 또는 신탁(이하 "출국만기보험등"이라 한다)에 가입하여야 한다. 이 경우 보험료 또는 신탁금은 매월 납부하거나 위탁하여야 한다. <개정 2014.1.28>
An employer of a business or workplace that hires a foreign worker (hereinafter referred to as the "employer") shall subscribe to insurance or a trust (hereinafter referred to as "departure guarantee insurance, etc.") for which the foreign worker is the insured or beneficiary (hereinafter referred to as the "insured, etc.") for the purpose of paying severance pay upon the departure of the foreign worker. In this case, premiums or trust funds shall be paid or entrusted monthly. <Amended on January 28, 2014>
사용자가 출국만기보험등에 가입한 경우 「근로자퇴직급여 보장법」 제8조제1항에 따른 퇴직금제도를 설정한 것으로 본다.
When an employer subscribes to departure guarantee insurance, etc., it shall be deemed that the severance pay system under Article 8 (1) of the "Act on the Guarantee of Retirement Benefits for Workers" has been established.
출국만기보험등의 가입대상 사용자, 가입방법ㆍ내용ㆍ관리 및 지급 등에 필요한 사항은 대통령령으로 정하되, 지급시기는 피보험자등이 출국한 때부터 14일(체류자격의 변경, 사망 등에 따라 신청하거나 출국일 이후에 신청하는 경우에는 신청일부터 14일) 이내로 한다. <개정 2014.1.28>
Matters necessary for the scope of employers eligible to subscribe to departure guarantee insurance, etc., subscription methods, contents, management, and payment shall be determined by Presidential Decree, and the timing of payment shall be within 14 days from the date of departure of the insured, etc. (within 14 days from the date of application if applying due to a change in residency status, death, etc., or after the date of departure). <Amended on January 28, 2014>
출국만기보험등의 지급사유 발생에 따라 피보험자등이 받을 금액(이하 "보험금등"이라 한다)에 대한 청구권은 「상법」 제662조에도 불구하고 지급사유가 발생한 날부터 3년간 이를 행사하지 아니하면 소멸시효가 완성한다. 이 경우 출국만기보험등을 취급하는 금융기관은 소멸시효가 완성한 보험금등을 1개월 이내에 한국산업인력공단에 이전하여야 한다. <신설 2014.1.28>
Notwithstanding Article 662 of the "Commercial Act", the right to claim the amount to be received by the insured, etc. (hereinafter referred to as "insurance money, etc.") due to the occurrence of a cause for payment of departure guarantee insurance, etc. shall be extinguished by prescription if not exercised within 3 years from the date on which the cause for payment occurred. In this case, financial institutions handling departure guarantee insurance, etc. shall transfer insurance money, etc. for which the statute of limitations has expired to the Human Resources Development Service of Korea within 1 month. <Newly established on January 28, 2014>
