①

다음 각 호의 어느 하나에 해당하는 자에게는 500만원 이하의 과태료를 부과한다. <개정 1999.2.8, 2002.1.19, 2011.6.7, 2016.12.2, 2017.12.30, 2019.12.3>

  1. 1. 거짓이나 그 밖의 부정한 방법으로 제6조의2제1항에 따른 인증을 받은 자

  2. 1의2. 제6조의2제4항을 위반하여 인증표시 또는 이와 유사한 표시를 한 자

  3. 1의3. 제9조제2항의 규정에 위반하여 담배자동판매기를 설치하여 담배를 판매한 자

  4. 2. 제9조제9항에 따른 시정명령을 따르지 아니한 자

  5. 3. 제9조의3을 위반하여 가향물질을 표시하는 문구나 그림ㆍ사진을 제품의 포장이나 광고에 사용한 자

  6. 4. 제23조제2항의 규정에 위반하여 자료를 제출하지 아니하거나 허위의 자료를 제출한 자

A fine of not more than 5 million won shall be imposed on any person falling under any of the following subparagraphs. <Amended on Feb. 8, 1999, Jan. 19, 2002, Jun. 7, 2011, Dec. 2, 2016, Dec. 30, 2017, Dec. 3, 2019> 1. A person who obtained certification under Article 6-2 (1) by false or other dishonest means 1-2. A person who affixed a certification mark or a similar mark in violation of Article 6-2 (4) 1-3. A person who installed an automatic cigarette vending machine and sold cigarettes in violation of the provisions of Article 9 (2) 2. A person who failed to comply with a corrective order under Article 9 (9) 3. A person who used wording, drawings, or pictures indicating a flavoring substance on product packaging or advertisements in violation of Article 9-3 4. A person who failed to submit data or submitted false data in violation of the provisions of Article 23 (2)

다음 각호의 1에 해당하는 자는 300만원 이하의 과태료에 처한다. <신설 2002.1.19, 2003.7.29, 2011.6.7>

  1. 1. 제9조제3항의 규정에 위반하여 성인인증장치가 부착되지 아니한 담배자동판매기를 설치하여 담배를 판매한 자

  2. 2. 삭제<2011.6.7>

  3. 3. 제28조의 규정에 의한 보고를 하지 아니하거나 허위로 보고한 자와 관계공무원의 검사를 거부ㆍ방해 또는 기피한 자

A person falling under any of the following subparagraphs shall be subject to an administrative fine of not more than 3 million won. <Newly enacted on Jan. 19, 2002, Jul. 29, 2003, Jun. 7, 2011> 1. A person who installed an automatic cigarette vending machine not equipped with an adult verification device and sold cigarettes in violation of the provisions of Article 9 (3) 2. Omitted <Jun. 7, 2011> 3. A person who failed to report or reported falsely as prescribed by Article 28, or who refused, obstructed, or evaded inspection by relevant public officials

다음 각 호의 어느 하나에 해당하는 자에게는 10만원 이하의 과태료를 부과한다. <신설 2010.5.27, 2016.3.2, 2017.12.30, 2020.12.29>

  1. 1. 제8조의4제2항을 위반하여 금주구역에서 음주를 한 사람

  2. 2. 제9조제8항을 위반하여 금연구역에서 흡연을 한 사람

A fine of not more than 100,000 won shall be imposed on any person falling under any of the following subparagraphs. <Newly enacted on May 27, 2010, Mar. 2, 2016, Dec. 30, 2017, Dec. 29, 2020> 1. A person who drank alcohol in a non-drinking zone in violation of Article 8-4 (2) 2. A person who smoked in a non-smoking zone in violation of Article 9 (8)

제1항부터 제3항까지의 규정에 따른 과태료는 대통령령으로 정하는 바에 따라 보건복지부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장이 부과ㆍ징수한다. <신설 2017.12.30>

The administrative fines under paragraphs ① through ③ shall be imposed and collected by the Minister of Health and Welfare, the Special Metropolitan City Mayor, the Metropolitan City Mayor, the Do governor, or the Mayor, County Governor, or District Head, as prescribed by Presidential Decree. <Newly enacted on Dec. 30, 2017>

제3항에도 불구하고 과태료 납부 대상자가 대통령령으로 정하는 바에 따라 일정 교육 또는 금연지원 서비스를 받은 경우 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 과태료를 감면할 수 있다. <신설 2019.12.3>

Notwithstanding paragraph ③, the Special Metropolitan City Mayor, the Metropolitan City Mayor, the Do governor, or the Mayor, County Governor, or District Head may reduce or remit the administrative fine if the person liable to pay the fine receives certain education or cessation support services as prescribed by Presidential Decree. <Newly enacted on Dec. 3, 2019>
