Article 75-2 (Inspection or Issuance of Certificate of Alien Stay)
제75조의2 외국인체류확인서의 열람 또는 교부

법 제88조의3에 따른 외국인체류확인서(이하 "외국인체류확인서"라 한다)의 열람 또는 교부를 신청하려는 자는 별지 제139호의3서식의 외국인체류확인서 열람 또는 교부 신청서에 다음 각 호의 서류를 첨부해 지방출입국ㆍ외국인관서의 장이나 읍ㆍ면ㆍ동의 장 또는 출장소장(이하 이 조에서 "열람 또는 교부기관의 장"이라 한다)에게 신청해야 한다.
1. 신청인의 신분증명서(법인ㆍ단체의 경우에는 대표자의 신분증명서, 법인인감증명서 또는 사용인감계를 말하며, 이하 이 조에서 같다)
2. 신청인이 법 제88조의3제2항 각 호의 어느 하나에 해당함을 입증하는 서류
A person who wishes to apply for the inspection or issuance of a Certificate of Alien Stay (hereinafter referred to as "Certificate of Alien Stay") pursuant to Article 88-3 of the Act shall submit an application form for inspection or issuance of a Certificate of Alien Stay in Form No. 139-3 of the Attached Forms, along with the documents listed in the following subparagraphs, to the head of a regional immigration and foreign affairs office, the head of an Eup/Myeon/Dong office, or the head of a branch office (hereinafter referred to as "head of the inspecting or issuing authority" in this Article). 1. The applicant's identification certificate (in the case of a corporation or organization, the representative's identification certificate, corporate seal certificate, or business seal statement, hereinafter the same in this Article) 2. Documents proving that the applicant falls under any of the subparagraphs of Article 88-3 (2) of the Act
제1항제2호에 따른 입증서류의 범위는 별표 5의3과 같다. 이 경우 열람 또는 교부기관의 장은 신청인의 동의를 받아 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용(「주택임대차보호법」 제3조의6제2항 후단에 따른 전산처리정보조직의 이용을 포함한다. 이하 이 항에서 같다)을 통해 별표 5의3의 입증서류를 확인할 수 있으며, 신청인이 그 확인에 동의하지 않거나 해당 행정정보의 공동이용을 통해 확인할 수 없는 경우에는 해당 서류를 직접 제출하게 해야 한다.
The scope of supporting documents for proof as referred to in subparagraph 2 of paragraph ① shall be as specified in Attached Table 5-3. In this case, the head of the inspecting or issuing authority may, with the consent of the applicant, verify the supporting documents in Attached Table 5-3 through the joint use of administrative information pursuant to Article 36 (1) of the 「Electronic Government Act」 (including the use of computer processing information systems pursuant to the latter part of Article 3-6 (2) of the 「Housing Lease Protection Act」, hereinafter the same in this paragraph). If the applicant does not consent to such verification, or if the supporting documents cannot be verified through the joint use of administrative information, the applicant shall be required to submit the documents directly.
제1항에도 불구하고 열람 또는 교부기관의 장은 외국인체류확인서의 효율적인 열람ㆍ교부를 위해 필요하다고 인정하는 경우에는 구술로 외국인체류확인서의 열람 또는 교부를 신청하게 할 수 있다. 이 경우 열람 또는 교부기관의 장은 신청인으로 하여금 제1항 각 호의 서류를 제출하도록 해야 한다.
Notwithstanding paragraph ①, if the head of the inspecting or issuing authority deems it necessary for the efficient inspection or issuance of the Certificate of Alien Stay, the application for inspection or issuance of the Certificate of Alien Stay may be made orally. In this case, the head of the inspecting or issuing authority shall have the applicant submit the documents listed in the subparagraphs of paragraph ①.
열람 또는 교부기관의 장이 제3항에 따라 구술로 외국인체류확인서의 열람 또는 교부를 신청하게 하는 경우 관계 공무원은 별지 제139호의3서식에 그 말한 사항을 적어 이를 신청인에게 읽어 들려주고, 신청인으로 하여금 서명 또는 날인하거나 손도장을 찍도록 해야 한다.
When the head of the inspecting or issuing authority allows an oral application for inspection or issuance of the Certificate of Alien Stay pursuant to paragraph ③, the relevant public official shall record the spoken matters in Form No. 139-3 of the Attached Forms, read it aloud to the applicant, and have the applicant sign or affix their seal or thumbprint.
열람 또는 교부기관의 장은 다른 관할에 소재하는 건물 또는 시설에 대해서도 외국인체류확인서의 열람 또는 교부를 할 수 있다.
The head of the inspecting or issuing authority may conduct the inspection or issuance of the Certificate of Alien Stay for buildings or facilities located in other jurisdictions.
동일 신청자가 동일 증명자료에 따라 동일 목적으로 여러 건물 또는 시설에 대해 외국인체류확인서의 열람 또는 교부를 신청하는 경우에는 별지 제139호의3서식과 별지 제139호의4서식에 따라 일괄 신청할 수 있다.
When the same applicant applies for the inspection or issuance of the Certificate of Alien Stay for multiple buildings or facilities based on the same supporting documents for the same purpose, the application may be made collectively according to Form No. 139-3 and Form No. 139-4 of the Attached Forms.
외국인체류확인서는 별지 제139호의5서식과 같다.
The Certificate of Alien Stay shall be in Form No. 139-5 of the Attached Forms.
열람 또는 교부기관의 장은 외국인체류확인서를 열람 또는 교부하게 하였을 때에는 별지 제139호의6서식의 외국인체류확인서 열람ㆍ교부대장에 그 사실을 기록하고 관리해야 한다.
When the head of the inspecting or issuing authority conducts the inspection or issuance of the Certificate of Alien Stay, the facts shall be recorded and managed in the register of inspection and issuance of the Certificate of Alien Stay in Form No. 139-6 of the Attached Forms.
열람 또는 교부기관의 장은 동일한 자가 동시(같은 날 여러 번 신청하는 경우를 포함한다)에 많은 양의 외국인체류확인서 열람 또는 교부를 신청해 처리기간 안에 처리하기 어려운 경우에는 30통마다 열람 또는 교부기간을 1일씩 연장할 수 있다.
If the head of the inspecting or issuing authority deems it difficult to process a large volume of applications for inspection or issuance of the Certificate of Alien Stay within the processing period, because the same person applies for a large quantity of Certificates of Alien Stay simultaneously (including multiple applications on the same day), the inspection or issuance period may be extended by one day for every 30 copies.
법 제88조의3제2항제2호에 따라 본인의 위임을 받은 자가 외국인체류확인서의 열람 또는 교부 신청을 하는 경우에는 위임장과 위임한 자 및 위임을 받은 자의 신분증명서를 함께 제출해야 한다.
When a person authorized by the principal applies for the inspection or issuance of the Certificate of Alien Stay pursuant to Article 88-3 (2) 2 of the Act, a power of attorney and the identification certificates of the person who granted the power of attorney and the person who received the power of attorney shall be submitted together.
