제91조의4 진폐유족연금

진폐유족연금은 진폐근로자가 진폐로 사망한 경우에 유족에게 지급한다.
A pneumoconiosis survivor's pension shall be paid to the surviving family members when a pneumoconiosis worker dies from pneumoconiosis.
진폐유족연금은 사망 당시 진폐근로자에게 지급하고 있거나 지급하기로 결정된 진폐보상연금과 같은 금액으로 한다. 이 경우 진폐유족연금은 제62조제2항 및 별표 3에 따라 산정한 유족보상연금을 초과할 수 없다.
A pneumoconiosis survivor's pension shall be the same amount as the pneumoconiosis compensation pension paid or decided to be paid to the pneumoconiosis worker at the time of death. In this case, a pneumoconiosis survivor's pension shall not exceed the survivor's compensation pension calculated according to Article 62 (2) and Table 3.
제91조의6에 따른 진폐에 대한 진단을 받지 아니한 근로자가 업무상 질병인 진폐로 사망한 경우에 그 근로자에 대한 진폐유족연금은 제91조의3제2항에 따른 기초연금과 제91조의8제3항에 따라 결정되는 진폐장해등급별로 별표 6에 따라 산정한 진폐장해연금을 합산한 금액으로 한다.
In the case where a worker who has not received a diagnosis of pneumoconiosis according to Article 91-6 dies from pneumoconiosis, an occupational disease, the pneumoconiosis survivor's pension for that worker shall be the sum of the basic pension according to Article 91-3 (2) and the pneumoconiosis disability pension calculated according to Table 6 based on the pneumoconiosis disability grade determined according to Article 91-8 (3).
진폐유족연금을 받을 수 있는 유족의 범위 및 순위, 자격 상실과 지급 정지 등에 관하여는 제63조 및 제64조를 준용한다. 이 경우 "유족보상연금"은 "진폐유족연금"으로 본다.
The scope and order of surviving family members who can receive a pneumoconiosis survivor's pension, loss of qualification, suspension of payment, etc. shall be applied mutatis mutandis to Articles 63 and 64. In this case, "survivor's compensation pension" shall be regarded as "pneumoconiosis survivor's pension."
