제91조의9 진폐에 따른 요양급여의 지급 절차와 기준 등

공단은 제91조의8제2항에 따라 요양급여를 지급하기로 결정된 진폐근로자에 대하여는 제40조제2항 본문에도 불구하고 산재보험 의료기관 중 진폐근로자의 요양을 담당하는 의료기관(이하 "진폐요양 의료기관"이라 한다)에서 요양을 하게 한다.
The Corporation shall provide medical care for pneumoconiosis workers who have been decided to be paid medical benefits under Article 91-8(2) at a medical institution that handles medical care for pneumoconiosis workers among the industrial accident insurance medical institutions (hereinafter referred to as "medical institutions for pneumoconiosis medical care"), notwithstanding the main clause of Article 40(2).
고용노동부장관은 진폐요양 의료기관이 적정한 요양을 제공하는 데 활용할 수 있도록 전문가의 자문 등을 거쳐 입원과 통원의 처리기준, 표준적인 진료기준 등을 정하여 고시할 수 있다. <개정 2010.6.4>
The Minister of Employment and Labor may establish and publicly notify the criteria for inpatient and outpatient treatment, standard medical treatment criteria, etc., through expert consultations, etc., to be utilized by medical institutions for pneumoconiosis medical care in providing appropriate medical care. <Amended on June 4, 2010>
공단은 진폐요양 의료기관에 대하여 시설, 인력 및 의료의 질 등을 고려하여 3개 이내의 등급으로 나누어 등급화할 수 있다. 이 경우 그 등급의 구분 기준, 등급별 요양대상 환자 및 등급별 요양급여의 산정 기준은 고용노동부령으로 정한다. <개정 2010.6.4>
The Corporation may classify medical institutions for pneumoconiosis medical care into no more than three grades, considering facilities, personnel, and quality of medical care. In this case, the criteria for classifying grades, patients eligible for medical care by grade, and the calculation standards for medical benefits by grade shall be determined by the Ordinance of the Ministry of Employment and Labor. <Amended on June 4, 2010>
진폐요양 의료기관을 평가하는 업무에 대하여 자문하기 위하여 공단에 진폐요양의료기관평가위원회를 둔다. 이 경우 진폐요양의료기관평가위원회의 구성ㆍ운영이나 그 밖에 필요한 사항은 고용노동부령으로 정한다. <개정 2010.6.4>
A Committee for the Evaluation of Medical Institutions for Pneumoconiosis Medical Care shall be established within the Corporation to advise on the work of evaluating medical institutions for pneumoconiosis medical care. In this case, the composition and operation of the Committee for the Evaluation of Medical Institutions for Pneumoconiosis Medical Care, and other necessary matters, shall be determined by the Ordinance of the Ministry of Employment and Labor. <Amended on June 4, 2010>
진폐요양 의료기관에 대한 평가에 관하여는 제50조를 준용한다. 이 경우 제50조제1항 중 "제43조제1항제3호의 산재보험 의료기관 중 대통령령으로 정하는 의료기관"은 "진폐요양 의료기관"으로 본다.
Article 50 shall apply mutatis mutandis to the evaluation of medical institutions for pneumoconiosis medical care. In this case, "medical institutions designated by the Presidential Decree among the medical institutions for industrial accident insurance under Article 43(1)3" in Article 50(1) shall be deemed as "medical institutions for pneumoconiosis medical care."
